We are keeping this week's update short and sweet. There are some major operational updates for some of you with the lifting of the Emergency Order. If we have any immediate updates for you before the next newsletter, we willpost them on Facebook.
DRINKS-TO-GO HAS TO-GONE
On Tuesday, Governor Wolf's Emergency Order was lifted, and with it went all order-related legislation.
This includes:
Mixed drinks to-go
Emergency temporary extension of premise permits from the LCB
The licensing of non-contiguous extended premises
What this means:
You can't sell mixed drinks to-go anymore. If your license allows, you can still sell beer and wine to-go as was permitted pre-COVID
If you don't have a standard extension of premises permit from the LCB you can't serve alcohol on sidewalk cafes (permits available through the PLCB+ Portal)
Regardless of if you have a standard extension of premises permit, you cannot service alcohol in an area non-contiguous to your licensed premises (so no crossing a sidewalk, street, or other sliver of property that is public or doesn't belong to you to serve).
HB 1154 Hangs In The Balance
HB 1154, the legislation that would allow for permanent mixed drinks to-go, has passed both the house and the senate as of this week. And while the governor has been a vocal advocate for the bill, a last-minute amendment that would allow for private distributors to sell canned mixed drinks to bars and restaurants has caused him concern, even vowing to veto the bill until it comes back to him "clean" - or, free of the privatization amendment.
"The RRF Replenishment Act has been introduced in the House and Senate. The measure would provide an additional $60 billion for the RRF – enough to process the existing applications in the SBA queue.
