China 301: USTR to Consider Extension of List 4 Exclusions

Today, the Office of the U.S. Trade Representative ("USTR")
announced the decision to consider the possible extension of exclusions granted
for products on List 4 of the Section 301 trade action against China. This
announcement covers products granted an exclusion in March, May, and June of 2020.
Any exclusions granted an extension by USTR will continue to be excluded from the Section 301 duties on List 4 for an additional 12 months.
Product exclusions eligible for extension during the new comment period include 81 individual exclusions that cover a variety of medical supplies and various electronics. A complete list of these exclusions are contained in five separate exclusion announcements published on March 10, 2020, March 17, 2020, March 31, 2020, May 13, 2020, and June 12, 2020. All of these exclusions are set to expire on September 1, 2020. The comment docket will open
July 1, 2020
and the deadline for submission of comment is
July 30, 2020

As discussed in yesterday's alert, USTR is also currently considering extensions for expiring List 2 and List 3
exclusions granted in September and October of 2019 and April and May of 2020, respectively. The deadline for comment on the extension of List 2 exclusions is
July 31, 2020

No exclusions have been extended by USTR in the absence of comments in support of extension. Therefore, we strongly recommend that you consider submitting comments in support of the extension of any product exclusions benefiting you or your suppliers.
