China 301: USTR Considers Extension of Certain List 2 Exclusions

Today, the Office of the U.S. Trade Representative ("USTR") announced the decision to consider the possible extension of certain exclusions granted
for products on List 2 of the Section 301 trade action against China. T
hese announcements only cover products granted an exclusion in September and October of 2019.
Any exclusions granted an extension by USTR will continue to be excluded from the Section 301 duties on List 2 for an additional 12 months.
Product exclusions eligible for extension during the new comment period include 200 individual exclusions contained in two separate exclusion announcements published on September 20, 2019 and October 2, 2019. A full list of the products excluded in the September notice can be found here. A full list of the products excluded in the October notice can be found here. These two sets of exclusions are set to expire on September 20, 2020 and October 2, 2020, respectively. The comment docket will open

and the deadline for submission of comment is
July 30, 2020

As discussed in our previous alert, USTR is also currently considering extensions for three different rounds of expiring List 3 exclusions granted in April and May of 2020. The deadline for comment on the extension of these List 3 exclusions is
July 7, 2020

No exclusions have been extended by USTR in the absence of comments in support of extension. Therefore, we strongly recommend that you consider submitting comments in support of the extension of any product exclusions benefiting you or your suppliers.
