HHS Proposes Major Updates to HIPAA Security Rule to Strengthen Cybersecurity

The Department of Health and Human Services (HHS) has proposed significant updates to the HIPAA Security Rule for the first time in two decades to better protect electronic protected health information (ePHI) from growing cyber threats. The proposed rule responds to the rise in large-scale healthcare breaches caused by hackers and ransomware between 2018 and 2023.

If enacted, it would require HIPAA-regulated entities to strengthen cybersecurity practices, including maintaining an updated technology inventory, conducting annual risk analyses, and using multi-factor authentication. It also mandates encrypting ePHI, vulnerability scans, penetration testing, and oversight of business associates. Additionally, stricter compliance documentation would be required, including disaster recovery plans and incident response protocols. The proposal also seeks feedback on how emerging technologies like AI and quantum computing should be regulated under HIPAA.

Comments on the proposed rule are due by March 7, 2025 and can be submitted through the federal register.
