Operational Memo 24-057

Developmental Disability Waiver Reserved Capacity Enrollments


Audience: Case Management Agencies, Case Managers, Home and Community Based (HCBS) Waiver Members, & Stakeholders


The purpose of this Operational Memo is to provide Case Management Agencies (CMAs) guidance regarding the requirements for Reserved Capacity Enrollments into the Home and Community-Based Services (HCBS) Developmental Disability (DD) program.

Colorado Department of Justice Settlement Agreement Summary


In September 2023, the Department of Justice (DOJ) filed a lawsuit against the State of Colorado, alleging non-compliance with the Americans with Disabilities Act (ADA) for operating our long-term services and supports system in a way that results in institutionalization. Because of the ongoing and strategic efforts to improve Colorado’s LTSS system, the State was positioned to negotiate a settlement that would advance Colorado’s goals. The Settlement Agreement was signed Oct. 31, 2024.

Live-in Caregiver Panel - Coming Soon!


HCPF will be making updates to the live-in caregiver (LIC) exemption process using the Gainwell Provider Web Portal. Some highlights of this change include:

  • Application requests and Revalidation Applications will be used for LIC exemption submissions and approvals.
  • Providers will receive notifications 60 and 30 days before expiration, on the day of expiration, and 30 days after. 
  • Strengthens overall exemption process
  • Simplifies exemption process
  • Uses existing Application requests and Revalidation Application processes
  • Notifications and reminders
  • Provider billing improvements
  • Improved and more timely billing feedback
  • Improves oversight while maintaining LIC flexibilities

Additional Information: Transitions Stakeholder Advisory Council (TSAC)


Note: With apologies, the OCL Digest is sending the following additional information about tomorrow's (Thursday) TSAC meeting. This information should have been included in last week's reminder.


Welcome to the TSAC monthly meeting. This is the place to talk openly about challenges and solutions related to Transition Services and programs. You can ask questions and get to know fellow options counselors, providers, transition counselors and everything in between that support community transitions.


This month the discussion will focus on HCPF's agreement with the Department of Justice (DOJ) to provide an overview and discuss next steps. 


The December meeting will also offer public training for the Department's new Money Follows the Person (MFP) Demonstration launching early next year. The training will provide a program overview, information about those eligible, and how to get connected. This is a great opportunity for all stakeholders to learn and prepare for the new program. There will be additional training offered in January 2025 to review program operations and provider requirements.

Training and Technical Assistance

New

At-Risk Diversion Office Hours


Beginning Tuesday, Dec. 10, 2024, HCPF is hosting office hours/work group sessions so Case Management Agencies can meet with HCPF staff and learn about At-Risk Diversion. During these times, HCPF staff will provide clarification and answer questions regarding At-Risk. All interested stakeholders are welcome.


At-Risk Diversion will offer additional support to Health First Colorado Medicaid Members living in the community who are identified by HCPF as At-Risk for Institutionalization. At-Risk Diversion will include additional support and services to members.


Case Managers and any other interested stakeholders can join any of the sessions listed below.

Long-term Home Health (LTHH) Policy Team Office Hours


The purpose of the LTHH Policy Team Office Hours is for advocates, providers, members, case managers, and other interested stakeholders to receive training, information sharing and technical assistance in an open forum working directly with HCPF staff. A record of questions and answers asked during Office Hours will be made available for future reference. All interested stakeholders are welcome.


The LTHH Policy Team office hours will be held on the second Tuesday of the month, 1 to 2 p.m. MT, through all of 2024.
