Broker-to-Broker Agreements May Still Exists Off the MLS

Participants are will soon be prohibited from communicating any offer of compensation via an MLS. (Bright MLS will be removing the option on August 14th, while the National Association of REALTORS® (NAR) Settlement prohibits REALTORS® from communicating compensation via the MLS as of August 17th.)

However, the National Association of REALTORS® (NAR) settlement expressly preserves offers of compensation as an option when agreed upon by the consumer and the broker.

Broker-to-broker agreements may:

• Memorialize the compensation agreement between brokers, in accordance with the seller’s authorization to the listing broker and the buyer’s agreement with the buyer broker

• Help make the path to homeownership accessible for all buyers

• Reduce confusion and misunderstanding of an offer of compensation

Court Rules Against Berkeley Age Ownership Restriction in Senior Living

The New Jersey Appellate Division of State Superior Court ruled against a Berkeley Township ordinance that bars individuals under the age of 55 from owning homes at certain senior housing communities.

The court ruled that the restriction violates the federal Fair Housing Act and New Jersey's Law Against Discrimination.

Federal law gives local governments the ability to restrict certain housing to elderly residents. But this restriction speaks for occupancy, not ownership.

Berkeley Township does have the right to appeal the ruling to the Supreme Court if they chose. The NEXUS Legislative Committee and New Jersey REALTORS® will stay at the front lines defending the rights of homeowners and keep you updated with any changes.
