Court Rules Against Berkeley Age Ownership Restriction in Senior Living
The New Jersey Appellate Division of State Superior Court ruled against a Berkeley Township ordinance that bars individuals under the age of 55 from owning homes at certain senior housing communities.
The court ruled that the restriction violates the federal Fair Housing Act and New Jersey's Law Against Discrimination.
Federal law gives local governments the ability to restrict certain housing to elderly residents. But this restriction speaks for occupancy, not ownership.
