SHIPS for America Act
According to the sponsors of the SHIPS for America Act (Shipbuilding and Harbor Infrastructure for Prosperity and Security), it entails the first all-encompassing strategic approach looking at all the challenges and providing a framework toward restoring the American merchant marine. Calling it the first wide-ranging approach to the problems of the industry, the legislation seeks to address the shortage of shipbuilding capacity and capabilities, the lack of U.S. flagged ships, and support mariners with improved training and credentialing programs overseen by a White House-level position, the Maritime Security Advisor.
Representative John Garamendi, Senator Mark Kelly, Senator Todd Young, and Rep. Trent Kelly introduced the bill. They said it will create jobs in shipbuilding and at sea as well as rebuild the merchant marine and support national security.

Tentative Agreement on a New Six-Year Contract Announced
This agreement, which now awaits ratification by ILA members in the coming weeks, ensures continued operations at major ports, safeguarding the stability of supply chains that handle nearly half of U.S. imports. Under the tentative deal, dockworkers will continue operating under the current contract until the new agreement is ratified by both parties.

Revised Port Tariff Taking Effect February 10, 2025
The anticipated changes to the tariff, effective February 10, 2025, can be viewed on The Port Authority of New York and New Jersey website: www.panynj.gov/port/tariffs.html. The anticipated changes are all highlighted in the tariff document.

CBP Issues Notice of Proposed Rulemaking to Enhance Enforcement as to Low-Value Shipments
U.S. Customs and Border Protection (CBP) announced a Notice of Proposed Rulemaking (NPRM) to strengthen CBP’s information collection requirements for low-value shipments, also known as de minimis shipments. The proposed Entry of Low-Value Shipments (ELVS) rule will enhance supply chain visibility and will enable CBP to better interdict illegal shipments across U.S. ports of entry.

Stay Up to Date on the Brooklyn Marine Terminal
The transformation of the Brooklyn Marine Terminal is part of the Adams administration’s broader strategy to develop the Harbor of the Future—a reimagined, East River-connected network of innovation and growth.
The Harbor of the Future includes emerging innovation centers at the Hunts Point Produce Market, Governors Island, the Brooklyn Navy Yard, the Science Park and Research Campus (SPARC) Kips Bay, and the North Shore of Staten Island.

Clean Ports Program Selections
The U.S. Environmental Protection Agency has made final awards for 53 of the 55 selected applications.
The U.S. Environmental Protection Agency announced 55 selected applications for nearly $3 billion in Clean Ports Program grants funded through the Inflation Reduction Act. The selected applications will fund zero-emission port equipment and infrastructure as well as climate and air quality planning at U.S. ports located in 27 states and territories

Cybersecurity in the Marine Transportation System
The Coast Guard is updating its maritime security regulations by establishing minimum cybersecurity requirements for US-flagged vessels, Outer Continental Shelf facilities, and facilities subject to the Maritime Transportation Security Act of 2002 regulations. This final rule addresses current and emerging cybersecurity threats in the marine transportation system by adding minimum cybersecurity requirements to help detect risks and respond to and recover from cybersecurity incidents. These include requirements to develop and maintain a Cybersecurity Plan, designate a Cybersecurity Officer, and take various measures to maintain cybersecurity within the marine transportation system. The Coast Guard is also seeking comments on a potential delay for the implementation periods for US-flagged vessels.

NOAA Withdraws Proposed Speed Rule for East Coast Whale Protection
After two years of review, the National Oceanic and Atmospheric Administration (NOAA) has decided to drop a proposed speed-limit rule intended to protect endangered North Atlantic right whales from ship strikes. The rule was opposed by East Coast seaports, which viewed the speed limits as a threat to commerce and a potential safety risk.

On or about January 15, 2025, CHPE, LLC and CHPE Properties, Inc. (collectively
referred to as “CHPE” or “Certificate Holders”) intend to submit an Environmental Management
& Construction Plan (“EM&CP”) for the Harlem River Cable Installation Segment (“Segment
20B”) of the proposed Champlain Hudson Power Express (“CHPE”) Project. The Harlem River
Cable Installation Segment EM&CP includes installation of approximately 6.2 miles of submarine
cable in the Harlem River, beginning at an industrial parcel in the Port Morris neighborhood of the
Bronx, and extending to the Hudson River, near the mouth of the Harlem River, several hundred
feet west of the Spuyten-Duyvil Railroad Bridge.

The Bureau of Ocean Energy Management (BOEM) announces its intent to prepare an environmental impact statement (EIS) (Unique Identification Number DOI–BOEM– OREP–2025–0001–EIS) for a construction and operations plan (COP) of an offshore wind energy facility submitted by Vineyard Mid-Atlantic, LLC (hereinafter referred to as Vineyard Mid-Atlantic or Proponent). This notice of intent (NOI) initiates the public scoping and comment process under the National Environmental Policy Act (NEPA) and under section 106 of the National Historic Preservation Act (NHPA). Vineyard Mid-Atlantic proposes to construct and operate the facility in Renewable Energy Lease Area OCS–A 0544 (Lease Area), which is approximately 43,056 acres and located approximately 24 statute miles (mi) offshore, south of Fire Island, New York, and approximately 60 statute mi offshore New Jersey. Vineyard Mid-Atlantic proposes to develop the entire Lease Area.

The U.S. Maritime Administration (MARAD) has published the 2025 Port Infrastructure Development Program NOFO stating that roughly $450 million in funding will be available for FY 2025. Newark Bay Dredging is a Team Effort: Supports Safe Navigation, Environment, Commerce | The U.S. Army Corps of Engineers, New York District, has completed dredging four federal navigation channels in New York-New Jersey Harbor ─ Newark Bay Main Channel, Port Newark, Port Elizabeth and South Elizabeth ⎼ through the Newark Bay Maintenance Dredging Project. The work supports deep-draft commercial vessels calling on The Port of New York that, in turn, generates billions for the regional economy each year. | | |

Final Recommendations on the Maritime Transportation Data System Requirements |
In December, FMC Commissioner Carl Bentzel released his final recommendations on the Maritime Transportation Data System Requirements. A summary of the findings are below.
i. Ocean carrier visibility: Provide real-time information on the status and location of ocean carriers in transit
ii. Terminal access: Standardize public information about terminal access for cargo retrieval
iii. Cargo status: Standardize how cargo status is characterized for cargo retrieval from marine terminal operators (MTOs)
iv. Intermodal rail carriers: Extend visibility and status information requirements to intermodal rail carriers that service ocean carrier shipments
v. Port-wide information: Provide general port-wide information, such as scheduling berthing and pilotage
vi. Data standards: Develop common data standards for maritime transportation
vii. Access policies: Develop access policies and protocols for maritime transportation data

As a nonprofit trade association, the Maritime Association serves its members by affecting policy change on local and national levels while promoting the regional industries' maritime services at sea and ashore.
Stakeholder engagement is vital to the Maritime Association in order to ensure the security of maritime assets, the sustainability of the marine environment, and grow the competitiveness of port services.
