Q. When a trustee's last name changes due to a marriage, do I need to update my trust?


A. In such a case, there is no need to update your trust. Whether your trustee is listed with their maiden or married name, it will not affect their legal standing or responsibilities as a trustee. As long as the individual's identity remains clear and they continue to fulfill their duties effectively, there is typically no requirement to amend the trust document solely for a name change due to marriage. However, it's always advisable to review your trust periodically and make updates as necessary for any significant changes in circumstances or preferences.

Q. If I sell my home, do I need to update my trust?


A. If the property's address is specified in your trust document, it's advisable to update it to reflect the change in ownership. However, if the trust only refers to "my home" without specifying the address, there's typically no need to update the trust solely due to the sale of the property.


Always consult with an estate planning attorney to ensure your trust accurately reflects your assets and intentions.
