On July 3, 2024, a Federal Judge imposed a stay order on the enforcement of the Center for Medicare and Medicaid Services' (CMS) new guardrails for Broker compensation, as outlined in CMS's 2025 final rule. The Federal Judge's ruling was in response to two lawsuits filed against CMS and extends to Medicare Brokers and Agents in all states.
Due to the stay order, CMS released revised 2025 Fair Market Value (FMV) amounts on July 18. The revised FMV amounts do not include the one-time $100 increase for initial enrollments or the one-time $50 increase for plan switcher enrollments as was outlined in the final rule.
