February 2023 Safety, Health & Sustainability Update
According to the Florida Chamber Safety Council's Florida Workplace Safety Report released in 2020:
 
Safety
Workers’ compensation is considered a “grand bargain” between employers and employees. Prior to workers’ compensation, workers would rely on lawsuits to recoup any medical costs or lost wages from an accident on the job. There was a high legal burden for workers to prove that the employer was at fault for the worker to receive any payments. Employers did not always benefit from the tort lawsuit system. If a company was found liable for a workplace accident, they might be required to pay exorbitant amounts to the worker. As more workers were successful in court and courts were being tied up by worker injury suits, states began to enact workers’ compensation laws. Ten states passed workers’ compensation laws in 1911 and by 1948 all states had some form of workers’ compensation in effect. Florida passed its first workers’ compensation legislation in 1935. It was part of an effort to attract industrial activity to the state during the Great Depression. Businesses interested in relocating requested the legal protection afforded under a workers’ compensation plan. Workers’ compensation programs replaced the lawsuit format and provided predictable regulation for the employer and reliable compensation for the employee. If injured on the job, 100 percent of medical costs incurred are covered by the employer and about two-thirds of lost wages are recouped. Employers in Florida can either cover these costs themselves or through private insurance. Florida does not have a state workers’ compensation fund. The state does have a Specialty Disability Trust Fund. This fund covers employees in the case of a second injury after they return to work. This helps incentivize employers to hire workers with disabilities associated from a previous injury on the job.

Health
While attitudes may be changing, the National Safety Council still found that employers were concerned about marijuana usage in the workplace. In a survey, 80 percent of employers noted they were concerned about a negative effect from marijuana usage. Employers in high risk industries have few ways to detect active marijuana impairment in their employees. Currently, employers can conduct drug tests to see if there is past drug use, but these tests cannot detect current impairment. Employers’ only recourse is to test the blood of employees after an accident occurs. There is currently no way to screen workers for sobriety before a shift begins to ensure safety. Technology could assist in addressing this issue. Drug testing technology that could quickly and effectively test employees to determine if there was a presence of altering substances within the last 12 hours could help employers screen only for active usage. Such technology could help companies prevent usage in the workplace while navigating the changing legal landscape. A quick test, much like temperature check for COVID-19 at the beginning of each shift, could do much to ensure that all employees were sober for the shift.

Sustainability
Toxic chemicals have a direct effect on human health and the environment. Exposure to toxic chemicals has been linked to severe health conditions. When measuring toxic chemical releases in pounds per square mile, Florida ranks 32nd lowest (19th highest in releases) in the nation. Florida releases more toxic chemicals per square mile than the national average.
