IMPORTANT

DSNY Mandatory Waste Containerization

for Food-Related Businesses

As part of NYC commitment to keeping our streets clean, the NYC Department of Sanitation (DSNY) is implementing a new rule to send rats packing. Starting August 1, all food-related businesses in NYC must use rigid containers with secure lids when setting out trash for collection. This rule impacts catering establishments, food manufacturers, food preparation establishments, food service establishments, food wholesalers, and retail food stores. Restaurants, grocery stores, delis, bodegas, caterers, or other businesses that sell or handle food must comply.

When to set out

Per recent setout rules, businesses that place waste on the curb have two options:

Place waste at the curb 1 hour before closing or after 8:00 PM

Store bins inside or outside

Containers should be stored inside or in a rear yard if possible. If space is not available, bins can be stored within three (3) feet of the building line when not set out for collection. Bins must be maintained in a neat and orderly manner and always allow for a clear path of pedestrian travel on the sidewalk.

DSNY Skip The Stuff! New Rule started July 31, 2023

It's time to SKIP THE STUFF, NYC!

No more plastic forks, ketchup packets and piles and piles of napkins gathering in our kitchen junk drawers, just waiting their turn to...end up in the trash.

New rules start July 31. Learn more: nyc.gov/skipthestuff

Effective July 31, 2023, New York City food service establishments* providing take-out and delivery service must comply with these restrictions:

  • Do not provide utensils, condiment packets, napkins, or extra containers to take-out or delivery customers, unless requested by the customer.
  • Your online ordering and delivery apps must be set to a default of not providing these items. You must provide customers with the option to request these items only if you offer them.
  • Delivery and courier services may not provide these items unless such items are requested by the customer.

*NOTE: These restrictions do not apply to self-serve stations inside a food service establishment.

Enforcement

These restrictions are effective July 31, 2023; there will be a warning period through June 30, 2024.

Beginning July 1, 2024, those not following the restrictions may receive a Notice of Violation. Fines for each Notice of Violation issued within a 12-month period are: $50 (1st Offense), $150 (2nd Offense), $250 (3rd and Subsequent Offenses).

Businesses should be prepared for visits from inspectors, at least annually as part of routine inspections or 311 investigations, from one or more of the following agencies:
