New Inquiries –
· 17 May 2023– Mr Greg Fleming– HRNSW Stewards have commenced an investigation in relation to a report from the Australian Racing Forensic Laboratory (ARFL) that Peptides VYSNFLR (T17 fragment), VNFYAWK (T6 fragment) and SLTTLLR (T11 fragment) were detected in the blood sample taken from RED HOT ASSASSIN prior to race 7, the ATWORTHY PARK SYDNEY DRAFT PACE (2270 metres) conducted at Wagga on Friday 3 March 2023.
The ‘B’ sample has been confirmed by Racing Analytical Services Limited (RASL) in Victoria for confirmation.
On 2 June 2023, HRNSW Steward’s suspended the Trainer’s Licence of Mr Fleming pursuant to Australian Harness Racing Rule (AHRR) 183.
Inquiries Conducted –
· 2 May 2023– Mr Nathan Turnbull pleaded guilty to a charge issued by HRNSW Stewards pursuant to AHRR 190 (1), (2) & (4) following a report from the Australian Racing Forensic Laboratory (ARFL) that Salicylic Acid above the threshold of 6.5 micrograms per millilitre in plasma was detected in the blood sample taken from HAPPY AS following its win in race 3, the APG 2022 BUYERS BENEFITS PACE (1720 metres) conducted at Dubbo on Friday 22 October 2021.
The ‘B’ sample was confirmed by the Hong Kong Jockey Club (HKJC).
Based on the available evidence, lucerne hay could not be excluded as the cause of the salicylic acid levels recorded in the subject sample.
Mr Turnbull was fined $5000.
The subject horse was disqualified under the provisions of AHRR 195.
· 3 May 2023– Mrs KerryAnn Morris pleaded guilty to two (2) charges issued by HRNSW Stewards pursuant to AHRR 190 (1), (2) & (4) following a report from the Australian Racing Forensic Laboratory (ARFL) that Levamisole was detected in the post-race urine samples taken from;
· BLACK EDITION NZ following its win in race 8, the DFK CROSBIE PACE (1609 metres) conducted at Newcastle on Saturday 12 December 2020;
· BLACK EDITION NZ following its win in race 1, the STAY SAFE, STAY HOME PACE (1720 metres) conducted at Penrith on Wednesday 30 December 2020.
The reserve portions and control solutions were confirmed by Racing Analytical Services Limited (RASL) in Victoria.
Mrs Morris was disqualified for a period of 6 months to commence immediately and the subject horse was disqualified under the provisions of AHRR 195.
Mrs Morris has appealed the decision of the HRNSW Stewards. An application for a Stay of Proceedings was declined.
· 9 May 2023– Mr Peter Wright was found guilty of a charge issued by HRNSW Stewards pursuant to AHRR 190 (1), (2) & (4) following a report from the Australian Racing Forensic Laboratory (ARFL) that Levamisole was detected in the post-race urine sample taken from post-race urine sample taken from the horse PARTY HAT following its win in race 5, the BLUEGUM MOTEL DUBBO PACE (1720 metres) conducted at Dubbo on Friday 6 May 2022.
The reserve portion and control sample were confirmed by Racing Analytical Services Limited (RASL) in Victoria.
Mr Wright was disqualified for a period of 12 months and the subject horse was disqualified under the provisions of AHRR 195.
· 11 May 2023– Mr Josh Powderly pleaded guilty to a charge issued by HRNSW Stewards pursuant to AHRR 190 (1), (2) & (4) following a report from the Australian Racing Forensic Laboratory (ARFL) that Morphine and Oripavine were detected in the post-race urine sample taken from HIPSTER DUFUSS following its win in race 1, the HES WATCHING @ TIPPERARY EQUINE PACE (2270 metres) conducted at Wagga on Friday 21 January 2022.
The reserve portion and control solution were confirmed by Racing Analytical Services Limited in Victoria.
In respect of that charge, Stewards determined that a conviction would be recorded, however, Stewards did not impose a penalty on Mr Powderly as they were satisfied that the detection of Morphine and Oripavine had resulted from environmental contamination.
Appeal Decisions –
· 3 May 2023– Mr Lleyton Green appealed the decision of HRNSW Stewards to suspend his driver’s licence for a period of 14 days after he was found guilty of a charge issued pursuant to AHRR 163(1)(a)(iii) when driving the horse MAXIMUS MERIDIUS in Race 1 at Tabcorp Park Menangle on Monday 24 April 2023. By decision of the NSW Harness Racing Appeal Panel the appeal was dismissed.
Mr Green appealed that decision to the NSW Racing Appeals Tribunal and subsequently withdrew that appeal.
· 16 May 2023– Mr Peter Turner appealed the decision of HRNSW Stewards to disqualify the horse AVAIDEN from Race 2 at Newcastle on Friday 5 May 2023. By decision of the NSW Harness Racing Appeal Panel the appeal was upheld. The disqualification of AVAIDEN was set aside and the horse was returned to the third finishing place in the subject race.
Integrity Information –
During the month of May 2023, HRNSW Integrity department obtained 819 Race day samples.
As per normal HRNSW procedure all samples have been submitted for analysis.
