Village Attorney John Dellagloria Gives an Update on the Village Bridge Litigation

On Wednesday, May 31, the Court held a Case Management Conference (CMC) to have the Village and County inform the Court as to the current status regarding any outstanding issues that need the Court’s attention before an eventual trial. The main issue for the Village was to remind the Court that there are still outstanding Motions to be ruled upon. One is the Village’s Motion for an Injunction, and the other is the County’s Motion for a Summary Judgment. It was also brought to the Court’s attention that the Army Corps of Engineers is accepting public comment on the eventual construction of the Bridge. We advised the Court that we will bring a separate Motion in this regard; while the Court has no jurisdiction over the Corps, we will ask the Court to again remind and instruct the County not to continue any construction irrespective of receiving a permit from the Corps. The next hearing on these Motions will be on July 5 at 3:00 p.m., and a link will be provided to those who want to hear, but not comment at the Hearing.
