IAFP Policy Statement on
Patient Rights to Health Care
|
|
The Iowa Academy of Family Physicians Board of Directors recently met to discuss the current legislative session and want to share the following statement as support for our physicians, patients and communities.
The Iowa Academy of Family Physicians stands firmly against any legislation that unnecessarily regulates the evidence-based practice of medicine, criminalizes physicians and medical care, threatens the patient-physician relationship, and inhibits the delivery of safe, timely, and comprehensive care, including gender-affirming care.
Patients must be able to depend on their physicians to help them make critical decisions about their personal health. Laws and mandates that restrict or create undue burdens in accessing these services endanger patients and put those of us who provide medical care—or even offer evidence-based information—at great risk. Our patients and families, not policymakers, must have the ability to make their own medical decisions.
The IAFP believes in everyone’s right to health care and advocates to protect family physicians. Physicians must be able to practice medicine that is informed by their years of medical training, by experience, and by the available evidence and be able to do so freely and without threat of punishment, harassment, or retribution.

The 10-year periodic training and testing will begin in 2023 for those who have an expiration date starting in January 2023. Important Updates from the AAFP
|
|
Below you will find important updates from the AAFP on the Braidwood Decision, Letters to the DEA on Telehealth Prescribing Rules, and the MATE Act Implementation.
-
On Thursday, a federal judge in Texas ruled that the ACA preventative service coverage requirements were unconstitutional under the Administrative Procedure Act. You can find the statement from the AAFP on the ruling HERE.
-
DEA recently released two proposed rules outlining potential regulations for telehealth prescribing of controlled substances and buprenorphine after the end of the COVID-19 PHE. You can read the AAFP comments to DEA on telemedicine prescribing of controlled substances HERE & the AAFP Comments to the DEA on Telehealth Buprenorphine prescribing HERE.
-
The DEA and SAMHSA recently issued clarifying guidance about the new one-time, 8-hour training requirement, also known as the MATE Act. You can view the letter with the AAFP's recommendation on the proposed rule HERE.
- Many previous trainings on safe prescribing and substance use disorder screening, brief counseling, and treatment, including training required to obtain an x-waiver, count towards and may completely satisfy the new training requirement,
- Currently, the DEA will ask physicians to attest to completing the training without requiring additional documentation, per the AAFP's advice
- The new training requirement takes effect June 27, but physicians have until their DEA license renewal date to complete any additional trainings. For example, a physician with a DEA license that expires on January 1, 2025 does not need to complete the 8-hour training requirement until they go to renew their license on/around Jan 1, 2025.
- Anyone who completed residency within the past five years of June 27, 2023 does not need to complete additional training.
