New Inquiries –
· 8 March 2023– Mr Scott Wade– HRNSW Stewards have commenced an investigation in relation to a report from the Australian Racing Forensic Laboratory (ARFL) that Levamisole had been detected in the post-race urine sample taken from CHANGE OF MIND following its win in Race 6, the SKY RACING ACTIVE PACE (2125 metres) conducted at Penrith on Thursday 5 January 2023.
The reserve portion and control solution have been confirmed by Racing Analytical Services Limited (RASL) in Victoria.
Inquiries Conducted –
· 20 March 2023– Mr Adam Ruggari pleaded guilty to a charge issued by HRNSW Stewards pursuant to AHRR 190 (1), (2) & (4) following a report from the Australian Racing Forensic Laboratory (ARFL) that 20-hydroxyecdysone was detected in the post-race blood sample taken from CAPTAIN DAN NZ following its win in race 2, the ARNALL TROPHIES PACE (1720 metres) conducted at Penrith on Thursday 13 October 2022. The ‘B’ sample was confirmed by Racing Analytical Services Limited in Victoria.
Based on the evidence before the Stewards they were satisfied to the requisite standard that the environmental contamination emanated from plants within Mr Ruggari’s registered training establishment. In respect of the charge Stewards determined that a conviction would be recorded, however, Stewards did not impose a penalty on Mr Ruggari.
Mr Ruggari was cautioned that he must take all reasonable measures in future to manage his training establishment and horses to ensure that his horses are not exposed to such plants and prohibited substances.
The subject horse was disqualified under the provisions of AHRR 195.
· 28 March 2023– Mrs Ashlee Grives was found guilty of a charge issued by HRNSW Stewards pursuant to AHRR 190 (1), (2) & (4) following a report from the Australian Racing Forensic Laboratory (ARFL) that naproxen had been detected in the post-race blood sample taken from FREDDY SINGH following its win in Race 10, the FINAL NIGHT MARQUEE 25TH MARCH PACE (2260 metres) conducted at Bathurst on Wednesday 9 March 2022. The ‘B’ Sample was confirmed by Racing Analytical Services Limited in Victoria.
In respect of that charge Stewards determined that a conviction would be recorded, however, Stewards did not impose a penalty on Mrs Grives as they were satisfied that the detection of naproxen had resulted from contamination in the stable environment through the farrier.
Mrs Grives was cautioned that she must take all reasonable measures in future to manage her training establishment and horses to ensure that her horses are not exposed to prohibited substances by any person, licensed or otherwise.
The subject horse was disqualified under the provisions of AHRR 195.
· 29 March 2023– Mr Les Enks pleaded guilty to a charge issued by HRNSW Stewards pursuant to AHRR 190 (1), (2) & (4) following a report from the Australian Racing Forensic Laboratory (ARFL) that Total Plasma Carbon Dioxide above the prescribed threshold was detected in the pre-race blood sample taken from NEVILLE SHANNON prior to it running in race 4, the TUMBY PARK RON WHITTON MEMORIAL (1609 metres) conducted at Tamworth on Friday 20 January 2023. The ‘B’ sample was confirmed by Racing Analytical Services Limited (RASL) in Victoria.
Mr Enks was disqualified for a period of 3 years to commence from 6 February 2023, the date upon which he was stood down pursuant to AHRR 183.
The subject horse was disqualified under the provisions of AHRR 195.
Appeal Decisions –
· 1 March 2023– Mr Brian Portelli appealed the decision of HRNSW Stewards of 17 February 2023 to suspend his driver’s licence for a period of 21 days after he pleaded guilty to a charge issued pursuant to AHRR 156(2) when driving the horse TASTY DELIGHT in Race 6 at Tabcorp Park Menangle on Saturday 14 January 2023. By decision of the NSW Harness Racing Appeal Panel the appeal against the severity of the penalty was dismissed.
· 1 March 2023– Mr Jack Brown appealed the decision of HRNSW Stewards to suspend his driver’s licence for a period of 21 days after he pleaded guilty to a charge issued pursuant to AHRR 163(1)(a)(iii) when driving the horse RAINING ON RINGO in Race 6 at Newcastle on 17 February 2023. By decision of the NSW Harness Racing Appeal Panel the appeal against the severity of the penalty was dismissed.
· 2 March 2023– Mr Scott Wade had his penalty determination finalised by the NSW Racing Appeals Tribunal. On 16 January 2023 the NSW Racing Appeals Tribunal found that Mr Wade had breached AHRR 190(1), (2) & (4) on two occasions.
On 2 March 2023, the NSW Racing Appeals Tribunal confirmed the penalty of 9 months disqualification for each offence (to be served concurrently).
· 6 March 2023– Mr Mitch Hutchings appealed the decision of the NSW Harness Racing Appeal Panel to disqualify him for a period of 18 months in relation to two (2) charges issued pursuant to AHRR 213 and AHRR 243 in relation to the mistreatment of a horse. Mr Hutchings appealed that decision to the NSW Racing Appeals Tribunal and by decision on Monday 6 March 2023 the appeal was dismissed and the penalty confirmed.
· 6 March 2023– Mr Peter Trevor-Jones had his penalty determination finalised by the NSW Racing Appeals Tribunal. On 22 December 2022, the NSW Racing Appeals Tribunal found that Mr Trevor-Jones had breached AHRR 190(1), (2) & (4). On 6 March 2023, the NSW Racing Appeals Tribunal confirmed the penalty of 3 months disqualification.
· 7 March 2023– Mr Michael Stanley appealed the decision of HRNSW Stewards to find him and guilty and suspend his driver’s licence for a period of 10 days in relation to a charge issued pursuant to AHRR 163(1)(a)(iii) when driving the horse SOHO SERAPHINE in Race 6 at Tabcorp Park Menangle on Saturday 25 February 2023. By decision of the NSW Harness Racing Appeal Panel the appeal was upheld and the penalty set aside.
· 9 March 2023– Ms Grace Panella appealed the decision of HRNSW Stewards to find her guilty and suspend her driver’s licence for a period of 21 days in relation to a charge issued pursuant to AHRR 163(1)(a)(iii) when driving the horse MAMMALS RIDDLE in Race 7 at Newcastle on Friday 24 February 2023. By decision of the NSW Harness Racing Appeal Panel the appeal was dismissed and the penalty confirmed.
· 13 March 2023– Mr Tim Williams submitted an application to appeal out of time in relation to a decision of HRNSW Stewards to find him and guilty and suspend his driver’s licence for a period of 14 days in relation to a charge issued pursuant to AHRR 163(1)(a)(iii) when driving the horse KAHLUA FLYBYE NZ in Race 6 at Tabcorp Park Menangle on Saturday 25 February 2023. The application to appeal out of time was refused by the NSW Harness Racing Appeal Panel.
· 13 March 2023– Mr Lleyton Green appealed the decision of HRNSW Stewards to find him guilty and suspend his driver’s licence for a period of 10 days in relation to a charge issued pursuant to AHRR 163(1)(a)(iii) when driving the horse PELICAN FLY in Race 6 at Newcastle on Friday 10 March 2023. By decision of the NSW Harness Racing Appeal Panel the appeal was upheld and the penalty of 10 days suspension was set aside. Mr Green was issued with a reprimand.
Integrity Information –
· During the month of February 2023, HRNSW Integrity department obtained 970 Race day samples.
As per normal HRNSW procedure all samples have been submitted for analysis.
