POSSIBLE UPCOMING HOA LAW CHANGES

The 88th Session of the Texas State legislature is in session and a large number of bills are before them that relate to POA / HOA / Condominium Associations and what these Association may or may not do in regards to various matters.

The full report can be downloaded below and provides a summary of each and the Community Association Institutes position on each. One particularly concerning item is a potential change to the law in HB 886 which would add an additional 9 months to the collection process HOA's are required to go through in an attempt to collect on delinquent accounts. Also of concern is HB 92 and HB 4995 which would prevent cities, counties, or property owner associations from outlawing the growing of fruits and vegetables and raising of chickens and rabbits, among other items as well.

If you would like to weigh in with your opinion on a particular bill and have your comments forwarded to the legislature you can email your comments to the Texas Legislative Action Committee at: tlac@caitexas.org.
