SB 642 – QBS for State Agencies
Work continues in the House to garner support for SB 642 after it unanimously passed the Senate earlier this year. The bill has been referred to the House Regulatory Reform Committee and is awaiting a hearing. The bill would require state agencies to use a qualifications-based selection (QBS) process to procure design professional services.
HB 5538 – Design-Build for Public Schools
Despite testimony in opposition to the bill by ACEC and AIA, HB 5538 passed the House earlier this month. Members from the design community are meeting with members of the Senate Regulatory Reform Committee this week to share concerns with the bill. If passed, the bill would allow a “design-builder” that employs a licensed engineer or architect to design, build and oversee the construction of a school building. This could put schools at risk as there would be no requirement for independent oversight of the design or construction by a licensed professional, only by the engineer/architect who is employed by the design-builder.
HB 6132 - Repeal of Act that requires retired state employees to forfeit their retirement payments if they return to work for the state
HB 6132 was introduced this week by Rep. Beth Griffin and would repeal a law passed in 2007 that required state retirees to suspend pension payments if they return to work for the state. With the declining number of state workers still receiving a pension and the shortage in the workforce, this bill will remove a barrier for state employees who would like to continue to work on state projects after they retire. The bill will receive a hearing Thursday, May 26 in the Committee on Workforce, Trades and Talent.

The 11th Annual Construction Science Expo was held on May 17 at a new location - Durfee Innovation Society. More than 500 middle and high school students from Detroit Public Schools experienced one of the best school field trips of the year while learning about a career in the engineering and construction industry.
Over 10,000 students have been invited to this annual hands-on expo over the last 10 years through the Detroit schools “Navigation to Success” Program run by the Black Caucus Foundation, with more than 50 activities presented by over 25 industry professionals.
Detroit Mayor Mike Duggan visited the Expo this year, interacted with the attendees and visited the various hands-on exhibits. The strong partnership between the engineering industry, contractors, and organized labor has resulted in an amazing event for the past 11 years and a fantastic opportunity for Detroit kids to experience the engineering & construction industry.

On September 21, 2022, ACEC/Michigan will be holding an Ethics Webinar. The Michigan Professional Engineers Board has implemented changes to the General Rules for Continuing Education requirements for all licensed Professional Engineers. The new Rules require 2 CEUs in Ethics under Rule 339.16040: “Of the 30 hours, at least 2 hours of continuing education must be earned in ethics, as it relates to professional engineering.”
The September 21 workshop offers a detailed discussion of the general obligations and the rules of conduct that apply to design professionals as prescribed by their code of ethics. The discussion then explores the most common types of complaints, along with select individual complaints and the decisions rendered by the National Ethics Council. Discussion will also include steps taken by designers to ethically respond to a federal agency guideline, stance of a state licensing Board and current research on ethics.
Experienced presenters from AXA XL and PCIA will lead the discussion. Registration is on the ACEC/M website.

MSPE Honors Engineers of the Year
MSPE Engineer of the Year
MSPE recently recognized our Engineer of the Year, Donald Nedervelt, PE, at the annual conference.
Don has had an exemplary engineering career, professionally and through meaningful relationships and volunteer positions in technical and professional societies. In his personal and professional life, he is a positive example of an engineer who exhibits a high standard of honesty and integrity, and dedication to protection of the public health, safety, and welfare.
Over the years, he has worked tirelessly with the MSPE scholarship program raising up new engineering students. As the current MSPE President, he has been a steady hand providing leadership, direction, and support for the Society’s work to benefit Professional Engineers in Michigan. He selflessly gives his time and is committed to this engineering organization, above and beyond his daily work or family responsibilities.
When speaking with others who actively participate with him at the Southwestern Chapter of MSPE and on the MSPE scholarship committee, they all reflect on his solid commitment to fellow PEs and the organization. They recognize his ability to provide thorough analysis and thoughtful questions and recommendations on issues that must be decided, like implementation of the new scholarship software or distribution of scholarship funds.
In 2018, he was inducted into the MSPE Assembly of Fellows, which also recognizes a MSPE member who demonstrates exemplary service to their profession, the Society, and their community. Less than one percent of all MSPE members advance to this highest volunteer membership rank.
MSPE Young Engineer of the Year
MSPE recently recognized our Young Engineer of the Year, Jarod Stuyvesant, PE, at the annual conference. Jarod has defined himself as an asset and future leader at Moore+Bruggink. He has great dedication to learning and has been able to take on larger projects as he has grown, both as a design engineer and project manager. He has been helping to train and mentor younger engineers and looks for opportunities to improve the business. He is a great client manager and conducts himself professionally and with integrity. He has presented at multiple MWEA seminars and conferences.
Jarod is currently leading the design of a large expansion project at the SCCMUA Wastewater plant and has been integral to several other large projects. He is also involved in several professional organizations.
