Judge invalidates FEC anonymous donor rule
A U.S. District Court judge on Aug. 3 issued a ruling that invalidates a Federal Election Commission (FEC) regulation that allows donors to anonymously contribute to nonprofit groups that seek to influence elections. U.S. District Court Judge Beryl Howell ruled that the FEC's treatment of such groups, including 501(c)(4) political groups, "fails to uphold the standard Congress intended when it required the disclosure of politically related spending."

ASAE's unrelated business income tax (UBIT) coalition continues to grow
ASAE continues to enlist tax-exempt organizations in a concerted effort to fix a provision in the new tax law that requires tax-exempt organizations to pay taxes on employee parking and transportation benefits. Last year's Tax Cuts and Jobs Act includes a provision requiring associations, charities, churches and other tax-exempt organizations to pay unrelated business income tax (UBIT) on employee fringe benefits, including parking and transportation.

White House pushing short-term health plans
The Trump administration issued a final rule Wednesday allowing for the sale and renewal of more short-term health plans that are designed to be inexpensive, but do not have to cover pre-existing conditions or comply with other Affordable Care Act (ACA) coverage requirements. Under the current rules, issued in 2016 by the Obama administration, short-term insurance cannot last for more than three months.

Lawmakers introduce lobbying reform bill
Sen. Michael Bennet (D-CO) and Rep. John Sarbanes (D-MD) introduced legislation July 25 to curb "pay-to-play" politics and strengthen lobbying disclosure laws. The bill would end the 20 percent threshold for lobbying registrations and would also require consultants who only provide "strategic advice in support of lobbying" to register.

No funding for AHPs in spending bills
Funding to implement the Labor Department's new rule expanding access to association health plans (AHPs) is not included in appropriations bills approved recently by House and Senate committees. The Labor Department's regulation was finalized in June, allowing more groups to form AHPs as an alternative to the Affordable Care Act health exchanges.

Senate steers clear of Johnson Amendment debate
The Senate last week passed a package of four appropriations bills that included $11.3 billion for the IRS but did not include a provision in the House-passed version that would weaken enforcement of the Johnson Amendment. The Johnson Amendment, a decades-old prohibition on churches and charities getting involved in political campaigns, has been a target of House conservatives and the Trump administration.
