Greetings from John

Despite the challenges that faced all of us during the last fifteen months, I am glad to report that, by working together, you and our Neutrals were able to continue to provide mediation and arbitration services to your clients. And now, things seem to be looking brighter in the coming months.
 
Not only did we continue to provide professional services to you and your clients in these difficult times, we also continued unabated to train our Neutrals. Most recently we convened - virtually - our 26th Annual Training Conference. This year’s program was special. It involved a Moderated Conversation between General Colin Powell and me during which he shared his “Lessons Learned Mediating Strategic Disputes.” It was fascinating. He confirmed for us that whether disputes are strategic (national, international) or in our own backyard, the best practices for resolving them are the same:

  • Get the facts.
  • Prepare to the fullest.
  • Listen, Listen, Listen.
  • Earn and maintain trust.
  • Identify the underlying needs (interests) of the parties.
  • Look for commonalities.
  • Be Patient.
  • Persevere!

General Powell was informative, gracious, and inspiring. We thank him for his significant input to our ongoing efforts to strive for Excellence.

As we go forward, I am happy to announce that we have been joined by new Neutrals. (See the announcements below.)  Please join us in welcoming these outstanding individuals to this important work.

Hon. Randall D. Smith (Ret.)
Retired Chief Judge, Chesapeake Circuit Court

The Honorable Randall Smith recently retired as Chief Judge after fifteen years of distinguished service on the 1st Judicial Circuit Court of Virginia. Judge Smith began his career as a Deputy Sheriff for the City of Chesapeake. After attending law school, he had a successful career in private practice and was the Commonwealth’s Attorney for the City of Chesapeake. He also served as local counsel for the Department of Transportation and as a former Chairman of the Chesapeake Board of Zoning Appeals.

Hon. James S. Yoffy (Ret.)
Retired Chief Judge, Henrico Circuit Court
The Honorable James Yoffy recently retired as Chief Judge of the 14th Judicial Circuit Court of Virginia after over fifteen years of distinguished judicial service in Henrico County. He began his judicial tenure as a Judge of the General District Court in Henrico County where he served for nearly six years. Early in his legal career, Judge Yoffy served as an Assistant Commonwealth’s Attorney for the City of Richmond and later as Deputy Assistant in that office. He subsequently enjoyed a private law practice in Richmond. Among his many credentials, Judge Yoffy was a member of the Virginia Criminal Sentencing Commission, the Circuit Court Forms Committee, and the Special Committee on Unauthorized Practice of Law and Legal Ethics Opinion. He is a former President of the Richmond Criminal Bar Association and former Chair of the Virginia State Bar Board of Governors Criminal Law Section.
