Welcome to the latest edition of the Monday Morning Messenger.


In our first story of the morning, the Texas Propane Gas Association reminds everyone that unless you paid for multiple years, your Hazmat Registration is due today to the U.S. DOT.


While we are on the subject of the DOT, we wanted to bring to your attention that the FMCSA's Drug and Alcohol Clearinghouse (DACH) has been tracking violations since its launch in January 2020. Starting today, the Texas Department of Public Safety is using that data, barring applicants with DACH violations and beginning CDL downgrades.

Annual Calendar

U.S. Hazmat Registration dueJuly 1, 2024

Each year, Propane retail & wholesale companies must register annually with the Pipeline Hazardous Materials Safety Administration (PHMSA) if they transport or offer shipments of hazardous materials that require placarding.


Registration Period

The 2024-2025 registration year is from July 1, 2024, to June 30, 2025.


Fees

- Small businesses & non-profits: $250 + $25 processing fee

- All other businesses: $2,575 + $25 processing fee - Fees scheduled to increase next year


Small Business Criteria. Propane retailers with <100 employees and propane wholesalers with <200 employees qualify for the $250 fee.


Deadline. Submit the completed registration statement and payment before July 1, 2024, or before engaging in activities requiring registration.


Check Registration Status. To see if your registration is due, search at PHMSA Hazmat Registration Search https://portal.phmsa.dot.gov/HazmatRegistrationSearch/


Penalties. Federal, state, or local officials may impose penalties for failing to register or meet recordkeeping requirements.

Message from the CDL Section of the Texas Department of Public Safety to CMV Employers

Effective July 1st, the Texas Department of Public Safety (DPS) will not process CDL or CLP applications for individuals barred under FMCSA's Drug and Alcohol Clearinghouse (DACH) regulations due to violations.


The DPS will also remove the commercial driving privilege from the licenses of prohibited drivers listed in the DACH database.

 

To change the Clearinghouse status from “prohibited” to “not prohibited,” the driver must complete the return-to-duty (RTD) process through their employer.

 

Timeline of DACH implementation:

  

  1. Beginning July 1, 2024, DPS will confirm the driver’s eligibility status in the DACH database for all CDL and CLP transactions. If the driver is not eligible, the transaction will be canceled.
  2. During the first week of July, DPS will send a notice to all drivers on the prohibited list in the DACH database to comply with DACH requirements. These drivers were prohibited from January 6, 2020, to July 1, 2024.
  3. Drivers who do not comply with the DACH requirements will receive the downgrade notice of the CDL or CLP privileges until they complete the Return to Duty (RTD) process.
