Announcement from Secretary Kody Kinsley: Dave Richard Retiring

The mission of the Department of Health and Human Services starts with the words “In collaboration with our partners…” As a valued collaborator helping to ensure the health, safety, and well-being of all North Carolinians, I write to announce Deputy Secretary Dave Richard is retiring from state service on February 28th but will still be involved in the field to which he has contributed so much. He leaves N.C. Medicaid stable, strong, and with a robust team of leaders to carry the torch.


Few have done more to improve the health and wellbeing of North Carolinians. Dave joined the Department in 2013 and served the last 8 years as Deputy Secretary for N.C. Medicaid. He made it his focus to improve our mental health system, increase community-based supports for those with disabilities, and partner with providers. In Medicaid, he bolstered the financial stability of the program and worked closely with the General Assembly, to shape the vision for managed care. These are only a few of his many transformational accomplishments. 


Moreover, many will reflect on Dave as a source of support and wise counsel. He has lifted others up, built incredibly strong teams, and invested in the development and success of so many colleagues. We are a better Department, and a better state, because of his service and leadership. 


As Dave and I discussed his departure, we agreed that the Medicaid program is fortunate to have talented and dedicated leadership team and staff that will continue to provide high quality service to beneficiaries and continue driving us toward more value for our dollars spent on the program. 


Considering the stability and skills of this leadership team, I’m pleased to announce that Dave’s deputy, Jay Ludlam will step into the role of Deputy Secretary for N.C. Medicaid on March 1. I’m grateful for Jay stepping up into this role and for what I know he will accomplish for Medicaid and the Department as a whole.


Jay currently serves as Assistant Secretary of Medicaid and has been at the Department since 2017. He has led Medicaid’s operational work that enables the delivery of care. This included spearheading implementation of the managed care model. The smooth rollout of the Standard Plans in 2021, which encompasses the vast majority of Medicaid beneficiaries, is a testament to his capability. Jay has deep Medicaid experience, having served in leadership roles in Missouri’s Medicaid program – including as their Medicaid Director -- and working for private managed care companies.  


Dr. Shannon Dowler remains a critical member of the N.C. Medicaid leadership team and in keeping with announcements made last year, she will take on the responsibilities as Assistant Secretary for Health Access and Chief Medical Officer for N.C. Medicaid. We are fortunate to have her policy and clinical expertise. Additionally, beginning in March, the Transition to Community Living (TCL) team, led by Sam Hedrick, will join the Health Equity portfolio under Deputy Secretary Debra Farrington. There is significant alignment between the TCL team’s work to enable access to services and supports for adults living with serious mental illness so they can live, work, and thrive in settings of their choice with the Health Equity team’s work. This shift will further our ability to advance the health and well-being of all North Carolinians.


Congratulations are certainly in order for Jay and Shannon, but for the moment, I want to reserve some space to thank Dave for his enormous and long-lasting contributions. We will have an opportunity to celebrate Dave soon, but for now, please join me in appreciation of his service. 

Update on Samantha R

We would like to share the that Superior Court Judge Allen Baddour has paused implementation in his ruling in Samantha R. et al. vs. NCDHHS. We requested the pause, or stay, because aspects of that ruling would have caused closures of many stable living situations. Also, there was no guarantee that the needed investments called for in the order would have come in time, potentially leaving thousands of individuals in a situation where they could’ve come to grave harm.

(Stay, Clarifying Order) We want to be clear: NCDHHS is committed to empowering people with disabilities with the tools and resources they need to live healthy, independent lives in their communities of their choosing. And transforming our system of care to one that really makes choice possible for everyone. 

 

NCDHHS agrees with the underlying goals of the court’s order — making community-based services available and accessible to those who want them. We have put forward a different plan that is informed by input from individuals with disabilities, family members, providers and multiple community stakeholders and that aligns with our approved Olmstead Plan. We believe this approach better meets the vision behind the court order, without putting lives at risk. Our Olmstead Plan considers the realities of an already stressed system and paces changes to avoid destabilizing the system. Fulfilling the long-term vision of the Olmstead Plan will take a sustained commitment from a variety of state partners, beginning with $150 million in annualized investments that will be included in the Governor’s recommended state budget.   

 

NCDHHS will continue its work to address the health and well-being of children, families, adults and elders with disabilities. We will continue to work in good faith with all parties and listen to feedback from a broad set of stakeholders to strengthen North Carolina’s ability to provide choice to individuals with I/DD. People with disabilities should have choices and be able to access services in the setting that is the best fit for them. For all of us, access to the community is essential for helping us all thrive.   

Children in the NC Health Choice Program Moving to Medicaid

On April 1, 2023, approximately 55,000 children receiving NC Health Choice health coverage will move to Medicaid and begin receiving additional physical and behavioral health services. This change will help save families money and increase access to care. NC Health Choice beneficiaries do not need to do anything to move to the Medicaid program. The move is automatic.

 

A provision included in the North Carolina state budget, approved in July 2022, directed the NC Department of Health and Human Services to move NC Health Choice beneficiaries to the Medicaid program.

 

Families with children moving from NC Health Choice to Medicaid will no longer have to pay enrollment fees or copays for medical visits and prescriptions. They will also have assistance getting to and from medical appointments through Non-Emergency Medical Transportation services and Early and Periodic Screening, Diagnosis and Treatment — a benefit designed to discover and treat health conditions before they become serious.

 

People impacted by this change should look for a letter in the mail from their local Department of Social Services in early March. They will get a new Medicaid ID card in the mail; however, their Medicaid ID (Recipient ID) will not change. They can continue to use the card they have now until the new one arrives.

Tailored Plan Auto-enrollment and Choice Period

On Feb. 1, 2023, eligible beneficiaries were automatically enrolled in one of six Behavioral Health I/DD Tailored Plans in preparation of the April 1, 2023, program launch. Until then, beneficiaries will continue to receive behavioral health, I/DD, substance use and traumatic brain injury (TBI) services as they do today.

 

The NC Medicaid Enrollment Broker is mailing enrollment packets to beneficiaries who were automatically enrolled, and to those who have the option to enroll with a Tailored Plan. Notices are also being sent to beneficiaries’ authorized representatives. Beneficiaries who no longer qualify for Tailored Plan will receive a notice from the Enrollment Broker about their health care options.

The packets provide details about Tailored Plan enrollment, including:

  • Name of the Tailored Plan in which the eligible beneficiary was enrolled and its Member and Recipient Services phone number
  •  Reminder that Tailored Plan benefits will begin April 1, 2023
  •  Other available health care options for each beneficiary, as applicable
  • Copay, Services and Drug List
  • How to select a primary care provider (PCP)
  • Contact information for the Enrollment Broker, which can provide choice counseling and make enrollment changes


The Tailored Plan choice period is Feb. 2–27, 2023. During this time beneficiaries should contact their Tailored Plan to choose a primary care provider (PCP) with their plan. If a beneficiary’s PCP is not shown in their Tailored Plan’s network of providers, they should check back regularly as the Tailored Plans continue to add new providers and the list is updated daily.

 

If a Tailored Plan beneficiary does not select a PCP during the choice period, one will be automatically assigned to them on Feb. 28, 2023. Beneficiaries can search and find providers on the Medicaid Enrollment Broker website.

Tailored Care Management Capacity Building Funds Guidance Released

To help ensure the successful implementation of Tailored Care Management (TCM), the Department launched the Tailored Care Management Capacity Building program. TCM providers certified as Advanced Medical Home Plus (AMH+) practices and Care Management Agencies (CMAs) are eligible to receive capacity building funding for investments in:  

  •  Care management-related health information technology (HIT) infrastructure,  
  • Hiring and training care managers, and 
  • Activities related to operational readiness (e.g., developing policies/procedures/workflows). 

 

NC Medicaid has released Advanced Medical Home Plus (AMH+) and Care Management Agency (CMA) Tailored Care Management Capacity Building Funds Guidance to answer recent questions regarding the TCM Capacity Building program. This document provides guidance on items such as:

 

  • Questions about what capacity building funds can be used for, such as staffing, training, hardware purchases, capital purchases, etc.; and
  • Timeframes for use of capacity building funds.

RSVP PCS Information

DHHS has identified multiple RSVP submissions for the same individuals, due to providers needing a RSVP/RSID # for PCS referral purposes.  This is a reminder that if you already have an RSVP/RSID # for an individual BUT PCS was not checked as a “reason for referral” on the initial referral, please do not submit a subsequent RSVP only for the purposes of obtaining a new number for PCS. Per our RSVP FAQ (attached), DHHS staff have administrative capability to add PCS as a “reason for referral” onto the initial referral that was previously submitted. Additionally, if you do not have an RSVP # and are not sure if an RSVP has already been submitted for an individual, please contact us at [email protected] and we will check the referral log to look for previous submissions, then provide you with the existing RSVP #, if one has been submitted. 

 

When submitting an email request to DHHS to request 1) PCS be added as a “reason for referral” to an existing RSVP/RSID #, or 2) verification about whether an individual has an existing RSVP/RSID #, please ensure that you are using a secure and encrypted email and include the following:

  1. Individuals full name
  2. Individual’s DOB
  3. Individual’s MID #
  4. RSVP/RSID # (Only needed when requesting for PCS to be added to an existing RSVP)

 

If no prior RSVP/RSID # is located after contacting DHHS for assistance, a new RSVP should be submitted by choosing all appropriate “reasons for referral” including PCS if needed. The RSVP URL is: https://www.myhousingsearch.com/nc/rsvp.  This information along with other pertinent information regarding RSVP can be found on the RSVP FAQ attached.

Now Accepting Applications for the 8th Annual NC Community Transitions Institute

It’s that time of year! I am pleased to announce that we are now accepting applications for our annual NC Community Transitions Institute. This year will be our 8th summer Institute!


The NC Community Transitions Institute (“The Institute”) is a hands-on, collaborative learning opportunity for professionals who support individuals with long-term care needs to transition from facility settings to their homes and communities. The program is designed to bring together professionals from diverse backgrounds who support transitioning individuals, and to develop best practices throughout the lifecycle of a transition. This Institute builds off existing person-centered thinking and motivational interviewing principles. However, the Institute furthers these principles and provides practical strategies for transition-specific application.


The Institute will be a FULLY IN-PERSON format this year incorporating 4 modules, two of which require participation, and two are optional to attend:

  • May 17 – 18, 2023: A Transitions Symposium exploring community-based resources important to supporting individuals in a quality transition landscape (Required Attendance).
  • June 5 – 6, 2023: A deep dive workshop in Person-Centered Thinking (Optional Attendance).
  • July 17 – 19, 2023: A deep dive workshop in Motivational Interviewing (Optional Attendance).
  • August 14 – 17, 2023: An immersive session focused on improving person-centered collaboration and communication skills inspired by motivational interviewing techniques and person-centered thinking practices (Required Attendance).


All sessions will be held from 9:00 – 4:00 and lunch will be provided.

NC Medicaid Clinical Coverage Policy Posting 45-day Public Comment Notice

Clinical Coverage Policy 8A-7, Ambulatory Withdrawal Management (WM) without Extended On-Site Monitoring and Clinical Coverage Policy 8A-8, Ambulatory Withdrawal Management (WM) with Extended On-Site Monitoring have been posted for a 45-day public comment period. These policies may be accessed at, Proposed Medicaid and NC Health Choice Policies.

The DHHS-NC Medicaid Medical Care Advisory Committee (MCAC) needs your help with its search for individuals that are dedicated, goal driven as well as focused on Medicaid and the culturally diverse population it serves. In order to provide beneficiaries with the best quality of life, we need individuals of various backgrounds, diverse points of views, and lived experiences to provide advice on Medicaid programs and services. Having a diverse, equitable, and an inclusive perspective will allow ideas to flourish, providing Medicaid with the best resources for all its beneficiaries. Current vacancies exist for individuals residing or working in Congressional Districts 11, the newly established District 14, as well as three At-Large seats.


Individuals who fit one of the previously identified categories may submit a statement of interest to the contact listed below. We truly appreciate your assistance with our search. Please note the deadline for submitting nominations is Friday, March 3, 2023.

  • others, including representatives of government, state and county medical societies, other professional and provider associations,
  • professionals in health insurance industry, health and medical education, healthcare finance, as well as community members and leaders,

Update to Site Visit Application Question

Currently, the Federal Requirements Page/Site Visit Completed question on manage change requests (MCRs), re-verification and re-enrollment applications is only displayed when a provider adds a taxonomy requiring a site visit (per the provider permission matrix (PPM)) and adds a new or existing location.

 

Effective Feb. 26, 2023, when a taxonomy requiring a site visit is added or reinstated to a new, reinstated, or existing location, NCTracks will present the Federal Requirements/Site Visit Completed question only if the provider has not completed a site visit within the past five years. Providers will not be required to complete a site visit if a site visit has been completed for the service location within the past five years.

 

This update will streamline the provider enrollment process and will apply only to applications submitted after implementation on Feb. 26, 2023.

 

Please note that due to the system changes, any enrollment, re-enrollment and re-verification applications that are in draft will be deleted on Feb. 26, 2023 to allow for updates to the application process. Providers are encouraged to submit their drafts prior to this date or wait to begin their application until after implementation if their application deadline allows.


Federal Enrollment Application Fee Increase for Year 2023

The federal fee for Medicaid enrollment has increased from $631 for calendar year (CY) 2022 to $688 for CY 2023.

 

NCTracks provides a record of federal fees and NC Enrollment fees by year so providers may note the updates. The Federal Fees & NC Enrollment Fees by Year spreadsheet can be found under Quick Links on the Provider Enrollment page.

 

The N.C. Division of Health Benefits (DHB) collects the federal fee as required under Section 6401(a) of the Affordable Care Act (ACA) detailing that the Secretary is to impose a fee on each "institutional provider of medical or other items or services and suppliers." Based upon provisions of the ACA, this fee will vary from year-to-year based on adjustments made pursuant to the Consumer Price Index for Urban Areas (CPI-U). 

 

The federal fee is required for the following:

  •  Initial enrollment application
  •  Re-enrollment application
  •  Manage change request (MCR) to add a new site location
  •  Re-verification application

 

This fee only applies to certain organizations. Please refer to the Provider Permission Matrix under Quick Links on the Provider Enrollment page to determine provider-specific enrollment requirements. Changes Coming to Managing Employee and Owner Attestation on NCTracks Applications

Currently, NCTracks compares the managing employees (ME) listed on an organization’s initial enrollment application against the managing employees listed in the Medicare Provider Enrollment, Chain and Ownership System (PECOS). If managing employees listed on the application does not match those listed in PECOS, the application is denied.

 

Effective Feb. 26, 2023, NCTracks will no longer compare the managing employees listed on organization initial enrollment applications to the managing employees listed in PECOS. Applications will no longer be denied due to managing employees on the application not matching those listed in PECOS.

 

Note: This change does not impact owners. Owners listed on organization initial enrollment application will still require matching against the owner listed in the Medicare Provider Enrollment Chain and Ownership System (PECOS) to avoid application denial.

 

The following attestation will no longer be required and will be removed from applications:

 

Managing agents and employees entered on this application match what was reported to the provider’s state business registration entity, licensure board and Medicare. NC Medicaid will compare the owners and managing employees entered on this application with the owners and managing employees listed on the provider’s Medicare enrollment record when applicable.

Checkwrite for the Week of Presidents Day

In keeping with the approved checkwrite schedule, on weeks with a holiday, the checkwrite date is typically a day later than usual. Because of the Presidents Day holiday on Monday, Feb. 20, 2023, the checkwrite date for the week of Feb. 20, 2023 will be Wednesday, Feb. 22, 2023.

 

The posting and availability of funds to provider bank accounts will depend on the provider’s financial institution. Bank of America customers should see their payments in their accounts on the day that the EFT is processed, which will be Thursday, Feb. 23, 2023. Providers who bank at other financial institutions should see payments the business day following the date that the EFT is processed, which will be Friday, Feb. 24, 2023. (Some may post sooner.)

 

The NCTracks Call Center and Pharmacy Prior Approval Unit will be open normal working hours on Presidents Day holiday, Feb. 20, 2023.

Special Enrollment Period for Consumers Losing Medicaid or CHIP Coverage.  

Last Friday, our office sent out information about an anticipated loss of health care coverage for millions of public health beneficiaries as the Public Health Emergency (PHE) for COVID-19 comes to a close. On that same day, the Centers for Medicare & Medicaid Services (CMS) announced a Special Enrollment Period for qualified beneficiaries of Medicaid and the Children’s Health Insurance Program (CHIP). Between March 31, 2023 and July 31, 2024, CMS will allow Marketplace-eligible consumers to submit a new application or update an existing application through HealthCare.gov. 


A recently released study, conducted pre-pandemic, showed that nearly two-thirds of disenrolled beneficiaries had a period of uninsuranceHealth care providers and other community-based organizations can assist with outreach to individuals and families who may lose coverage. To help you better understand what states can do, the nonprofit State Health & Value Strategies provides two resources for state Medicaid agencies, state-based marketplaces, labor departments, and employers. 


The first is an issue brief discussing strategies for helping people understand and navigate their coverage options. A companion brief describes the importance of a Medicaid disenrollment survey to monitor coverage changes (p. 4) associated with the unwinding of continuous enrollment. 

SAMHSA Adult Offender Re-Entry Program 

The Substance Abuse and Mental Health Services Administration (SAMHSA) will make approximately 33 awards, each up to $400,000 per year. Grants are intended to expand substance use disorder treatment and related recovery and re-entry services for individuals returning to their community from incarceration.

NIMH Releases a Strategic Framework for Addressing Youth Mental Health

The purpose of the National Institute of Mental Health (NIMH) Strategic Framework for Addressing Youth Mental Health Disparities for fiscal years 2022–2031 is to provide a conceptual approach to help guide NIMH activities, including research funding, stakeholder engagement, and workforce development, related to research on the mental health needs of youth impacted by racial and ethnic health disparities.

For the purposes of this Framework, “youth” is defined as persons aged 24 and under.

Carolina Journal: Controller, legislative leaders ask NC Supreme Court to block Leandro money transfer

In separate motions filed Wednesday, Controller Nels Roseland and top lawmakers asked the high court to restore a previous order from the N.C. Court of Appeals. With a rare “writ of prohibition,” that court had ruled that a trial judge could not force government officials to move money out of the state treasury without permission from the General Assembly.

Carolina Journal: Medicaid Expansion triggers can’t fix bad policy

A bill expanding the Medicaid entitlement program in North Carolina was filed this week in the N.C. House. It appears to be on a fast track to pass through that chamber early next week. This vote, likely Tuesday, would call for the single largest expansion of an entitlement program in the state’s history.


However, it comes when layoffs and inflation are creating uncertainty in the economy. Soon there will likely be fewer taxpayers generating revenue for the state and more enrolling in Medicaid. Expansion would fund taxpayer-paid Medicaid benefits to 600,000 mostly able-bodied, childless, working-age adults. The total number would likely be many, many more than that.

The Mount Airy News: Overworked, undertrained, not supported

A group of former Surry County Department of Social Services employees are offering a response to interim director Wayne Black's recent report to the county commissioners on Department of Social Services staffing. The four former social service workers asked that their names not be used, for fear of reprisals as well as the possibility of creating issues for those still working for the department. "We all have a lot of years of experience with DSS and we have said lots of this to anyone who would listen for a long time," one of the workers, known as Marge, said. "It got to the point where we couldn't continue to work in the environment, we were working in. We are talking so maybe people will listen and cause some changes."

Fox 8: North Carolina foster children with mental health challenges living in emergency rooms

The State Department of Social Services is admitting it's in an emergency situation when it comes to housing children in the foster care system, especially those with mental health challenges. FOX8 has confirmed dozens of children are living in hospital emergency rooms because there isn't a family to care for them.
