AHCA Updates for Long-Term Care Providers 
The Agency for Health Care Administration (AHCA) would like to offer a few updates for our long-term care providers. 

COVID-19 Vaccine Requests
The Florida Department of Health and AHCA wants to remind you that the vaccine allocation request process for providers has changed. AHCA is no longer submitting vaccine allocation requests for you.

All long-term care providers must work with your contracted pharmacy who will request the necessary allocation through the Florida SHOTS system. The pharmacies should submit their requests by noon each Wednesday in order to receive vaccines the following week. Please be certain to work with your contracted pharmacy if you have vaccine needs. 

If your pharmacy has questions on submitting vaccine allocations in Florida SHOTS, they may contact the VFC Program via email at FloridaVFC@FLHealth.gov or via phone at 1-877-888-7468 Option 1.

Governor DeSantis Issues Emergency Order
to Extend State of Emergency for 60 Days

On Tuesday, April 27, 2021, Governor DeSantis issued Executive Order 21-94, which extended the state of emergency for COVID-19 for another 60 days.

The order contained one interesting area of note for our senior living communities. Part of the order states:

“As Florida continues to realize a manageable trend in COVID-19 cases, over 8.5 million vaccinated individuals, a 4.7% unemployment rate well under the national average, and state revenues improving significantly from worst-case projections during the pandemic, gaining $4.1 billion additional projected revenue over three fiscal years from the August 2020 estimate, the state should prepare to resume non-emergency operations.” (emphasis added)

Based on this statement, there is a possibility that that the Governor may lift the COVID-19 state of emergency order just before the 4th of July holiday weekend. Senior living communities may want to start thinking about how community operations would change should the state of emergency order be lifted.

Florida Senior Living Association will be closely monitoring the status of the emergency and working to ensure the regulatory agencies provide clear guidance regarding how the transition to “new normal” operations should be implemented once the emergency is lifted.

Florida Supreme Court Adopts FSLA's Position

This week, we learned the Florida Supreme Court adopted FSLA's position on a summary judgement standard. By enacting this new amendment to the summary judgment standard, trials will be less lengthy, reduce cost, and reduce the valuable time at the hand of the court.
The summary judgment goals are to improve efficiency, fairness, reduce expenses, and reserve juries for factual dispute cases, thus saving time. Please see FSLA's brief and the court's amendment attached.
