SUBJ: 21-133 (Categorical Remission of Fines)

On June 16, Governor DeSantis issued Executive Order 21-132, a clemency order regarding a categorical grant of full pardons, and Executive Order 21-133, a clemency order regarding remission of fines. The Governor issued the orders under his authority under Article IV, Section 8(a), Florida Constitution, regarding clemency (that is, the orders are not issued as an emergency order).
EO 21-132 grants a full pardon to any individual or business that has been or could be arrested for, charged with, found guilty of, convicted of, subject to a withhold of adjudication for, subject to a plea of guilty or nolo contendere for, or otherwise subject to a sentence or penalty for all non-violent offenses related to local government COVID-19 restrictions. The Order does not apply to any COVID-19 related orders or enforcement taken by the State, and also does not apply to assisted living facilities, hospitals, or other healthcare providers.
EO 21-133 remits any fines, for individuals and businesses, imposed between March 1, 2020, and June 16, 2021, by any political subdivision of Florida related to local government COVID-19 restrictions. The Order does not apply to any COVID-19 related orders or enforcement taken by the State, and also does not apply to assisted living facilities, hospitals, or other healthcare providers.
