Standard Operating Procedure Law Effective April 20, 2022 Impacts All Brokerages
Recently, a number of laws have been passed in New York State pertaining to Fair Housing and these laws have a significant impact on real estate licensees. One of these laws requires real estate brokers who service residential homebuyers to create and publish “Standardized Operating Procedures” (the “SOP Law”) for their brokerage offices so that prospective purchasers understand what will be required from them when working with a real estate broker. There is some confusion surrounding the “SOP Law” because it was amended by a “Chapter Amendment” that was signed into law on March 18, 2022. The Chapter Amendment for the SOP Law gives the New York State Department of State (the “DOS”) the ability to hold public hearings and provide further regulatory guidance on the requirements of the SOP Law. Learn more.
Reasonable Modification and Accommodation Regulations Published by the Division of Human Rights
On December 2, 2020 Governor Cuomo signed into law a new “Reasonable Modification and Accommodation” tenant disclosure and notice requirement for “housing accommodations”. The new law adds two new paragraphs 2-b and 18-a to section 296 of the Executive Law (also known as the Human Rights Law). The requirement only applies to the rental of a “housing accommodation” and does not apply to other types of rentals or any purchase of real estate. It should be noted that paragraph 2-b and 18-a have identical requirements but 2-b is applicable to “publicly-assisted housing accommodations” and 18-a applies to all other “housing accommodations”. NAR Report Shows Share of Millennial Home Buyers Continues to Rise
The share of millennial homebuyers increased significantly last year. They now make up 43% of home buyers—the most of any generation. This is according to the latest study from NAR’s 2022 Home Buyer and Seller Generational Trends report, which examines the similarities and differences of recent home buyers and sellers across generations. Governor Hochul Extends State of Emergency
On March 16, Governor Hochul issued an Executive Order extending New York’s COVID-related state of emergency through April 15. As a result, real estate licensees are still prohibited from making any cold calls to the public. NYSAR and a coalition of businesses impacted by the telemarketing ban continue to meet with state lawmakers advocating for a change in the law that would limit the restrictions.
New York’s Climate Action Council Releases Public Hearing Schedule
New York’s Climate Action Council released its public hearing schedule this week. A total of 10 hearings are scheduled to take place at varying locations across the state with one hearing being held virtually between the dates of April 5 and May 11, 2022. The Council plans to make recommendations to the state Legislature and governor on steps to reduce carbon emissions statewide, including phasing out the use of natural gas and other fossil fuels in homes as soon as 2024. NYSAR has serious concerns with the Council’s Draft Scoping Plan, which was released in December of 2021, due to its lack of analysis on costs to homeowners and uncertainty in the state’s electric energy grid to handle such a transition in the timeframe being proposed, among other concerns.
