Hello, April! This year seems to be zooming by (pun intended). Spring is in the air and believe it or not, we are a little over 55 business days away from completing the requirements of the Annual Update, Budget Overview for Parents, local indicators, and the Local Control and Accountability Plan (LCAP).

As we move closer to the deadline of July 1, local educational agencies (LEAs) are focusing on presenting their proposed plans to parent advisory committees for feedback and input and then completing an initial draft.

The San Diego County Office of Education (SDCOE) is committed to supporting LEAs in developing and maximizing the impact of their plans. As this year progresses, we continue to offer professional learning opportunities designed to support you through the condensed timeline for getting stakeholder feedback and completing the LCAP. Accelerated LCAP Development Timeline
This year’s LCAP development timeline is shortened due to COVID-19 and other requirements, such as the Operations Written Report and the Learning Continuity Plan. Now that we are in April, it is time to:
  • Present proposed plan to required stakeholder advisory committees for feedback and input
  • Create the first draft of the 2021-22 LCAP, incorporating stakeholder input
  • Have the superintendent respond in writing to feedback from parent advisory committees
  • Plan for public notification for public hearing

Stakeholder Advisory Committees
Education Code (EC) 52063(a)(1) requires districts to establish a parent advisory committee that includes parents of students as defined in EC 42238.01 (English learner, low-income, and foster youth) to provide advice to the governing board and superintendent regarding Article 4.5, Local Control and Accountability Plans. A majority of the members must be parents.
  • Education Code 52063(a)(3) does not require the governing board of the school district to establish a new parent advisory committee if it has already established a parent advisory committee that meets the requirements of this subdivision, including any committee established to meet the requirements of the federal Elementary and Secondary Education Act, as amended by the federal Every Student Succeeds Act (Public Law 114-95), pursuant to Section 1116 of Subpart 1 of Part A of Title I of that act. 

Education Code 52063(b)(1) states that the governing board of a school district shall establish an English learner parent advisory committee if the enrollment of the school district includes at least 15 percent English learners and the school district enrolls at least 50 pupils who are English learners. A majority of members must be parents of English learners.  
  • Education Code 52063(b)(2) does not require the governing board of the school district to establish a new English learner parent advisory committee if the governing board already has established a committee that meets the requirements of this subdivision. Education Code 52062(a)(2) requires the superintendent to present the LCAP to the English learner parent advisory committee for review and comment. The superintendent shall respond, in writing, to comments received from the committee.

Presenting the LCAP Draft, Responding to Feedback
Education Code 52062(a)(1) requires the superintendent to present the LCAP to the parent advisory committee for review and comment. The superintendent shall respond, in writing, to comments received from the committee. 

Written Feedback Requirements
Education Code 52062(a)(3) requires the superintendent to notify members of the public of the opportunity to submit written comments regarding the specific actions and expenditures, using the most efficient method of notification possible. The district is not required to produce printed notices or to send notices by mail; however, all written notifications related to the LCAP are to be provided in compliance with the translation requirements in Education Code 48985.

Looking forward
As we look toward May and June, make sure you prepare the final draft of the LCAP for board approval and conduct a public hearing to receive stakeholder input, as required by statute.
LCAP Approval Process and Important Timelines
Criterion for Determining LCAP Approval — EC 52070(d)

Adherence to SBE Template:
  • The LCAP or Annual Update to the LCAP adheres to the template adopted by the State Board of Education pursuant to ED Code Section 52064. This includes following instructions for completing the template.

Sufficient Expenditures in Budget to Implement LCAP:
  • The budget for the applicable fiscal year adopted by the governing board of the school district includes expenditures sufficient to implement the actions and strategies included in the district’s board-adopted LCAP, based on the projections of the costs included in the plan. 
  • EC 42127(d)(1) states that the county superintendent of schools shall disapprove a budget if the county superintendent of schools determines that the budget does not include the expenditures necessary to implement an LCAP. 

Adherence to the SBE Expenditure Regulations:
  • The LCAP adheres to the expenditure requirements adopted pursuant to Education Code Section 42238.07, and Title 5, California Code of Regulations, Sections 15494-15497, for funds apportioned on the basis of the number and concentration of unduplicated pupils pursuant to Sections 42238.02 and 42238.03.

Education Code 52060 states that the adoption of the LCAP by the governing board of the school district will be effective for three years and will be updated on or before July 1 of each year. Note: The Budget Overview, Annual Update (and instructions), LCAP (and instructions) are required to be submitted to the San Diego County Office of Education within five days of board adoption. On or before Aug. 15:
  • County superintendent of schools may seek clarification in writing about the contents of the LCAP or Annual Update.
  • Within 15 days, the governing board of a school district shall respond, in writing, to requests for clarification.
  • Within 15 days of receiving response, the county superintendent of schools may submit recommendations, in writing, for amendments to the LCAP or Annual Update.
  • Within 15 days of receiving recommendations, the governing board of a school district shall consider the recommendations submitted by the county superintendent of schools in a public meeting.

On or before Oct. 8:
  • County superintendent shall approve a district’s LCAP, provided the district meets the three criteria in EC 52070(d).

Deeper Learning Series: Measuring and Monitoring Engagement
This year we offered a three-part series that focused on measuring, monitoring, and creating actionable LCAP goals for social, emotional, and mental health for pupils and staff. Participants focused on implementation by identifying actions and developing an action plan for the 2021-22 school year.

COVID-19 Assessment Frequently Asked Questions (FAQs)
A new section has been added to the California Department of Education's COVID-19 webpage with frequently asked questions related to the 2021 Spring Assessment Administration. The CDE is regularly updating the FAQs as new information is available.
CHSPE Administrations in April and May
Administration of the California High School Proficiency Examination (CHSPE) has been on hold due to COVID-19 restrictions; it was not administered in March 2020 nor in fall 2020. Assuming the continued lifting of local health officials’ restrictions and progress in county tier assignments, the CHSPE will be available to eligible students in April and May 2021. During both months, the test will be offered at limited times at two locations: Los Angeles County Office of Education and Sacramento County Office of Education. Registration for May testing will be available after April testing is completed. Additional 2021–22 CHSPE testing dates and locations will be posted in early June. SEL Support Header
Free Social and Emotional Learning Implementation Series
Join facilitators from SDCOE's Learning and Leadership Services, Student Services and Programs, and Innovation teams as well as district and local partners for a learning series around implementing social and emotional learning (SEL) in your classroom, team, school, and district. In a systems approach, sessions will examine SEL practice with a focus on culturally responsive, contextual implementation to center the needs of your students and adults. All sessions are held Tuesdays from 3:30 to 4:30 p.m.

Design your school SEL implementation and continuous improvement plan based on quantitative and qualitative data, self-assessment, and alignment processes.
