CAWA Members Convene at the Nation’s Capitol to Promote Right to Repair Legislation


Team CAWA was in full force at the Auto Care Association Fall Leadership Days and Legislative Summit September 20-23 in Washington DC. CAWA members were ready to take action to advocate for the Right to Repair Act H.R. 906.


CAWA members attended educational sessions and legislative briefings as well as receptions on Capitol Hill where they mingled with members of Congress and their staff during the event. The culmination of the Summit was a full court press on Capitol Hill.


Summit attendees met with hundreds of Senate and House Members and their staff asking for their support and co-sponsorship of the Right to Repair Act. As a result of their efforts, H.R. 906 was granted a hearing in the House Energy and Commerce subcommittee on Innovation, Data and Commerce, showing movement and momentum in our effort to pass Right to Repair legislation.

CAWA In Coalition Opposes ACA 13: Voting Thresholds


CAWA and a coalition of business groups opposed ACA 13 (Ward), which seeks to amend the constitution by limiting the initiative process, shifting the power to raise the voter threshold for new and higher taxes to the Legislature. ACA 13 will fundamentally change the initiative process by increasing the voter threshold to pass future limits on taxes and fees only for measures put on the ballot by signature gathering, not those put on by the Legislature. ACA 13 seeks to create various inequities between the voters, the Legislature, and local governments, and it represents yet another attempt to diminish the voice of voters as the right and necessary check-and-balance in our system of government. When Your Company Receives a Sexual Harassment Lawsuit, the First Question the Plaintiff’s Attorney Will Ask is: "Did You Provide the Legally Mandated Training to Your Employees?"


Required Harassment Prevention Training is Provided FREE to CAWA Members. Beginning January 1, 2019, California made substantial changes to its sexual harassment prevention training requirements. Under the 2019 changes, all employers with five or more employees must provide sexual harassment prevention training to all employees — supervisors must receive two hours of training and nonsupervisory employees (including seasonal and temporary employees hired to work for less than six months) must receive one hour. Training must take place within six months of hire or promotion and every two years thereafter. CAWA through its partner CoreMark provides this required training FREE to CAWA members. California’s Minimum Wage to Increase to $16 Per Hour in January 2024

California’s minimum wage will increase to $16 per hour for all employers on January 1, 2024. Some cities and counties in California have a local minimum wage that is higher than the state rate. State law requires that most California workers be paid the minimum wage. 


The change in the minimum wage also affects the minimum salary an employee must earn to meet one part of the overtime exemption test. Exempt employees are not subject to the payment of overtime for hours worked. An employee must earn no less than two times the state’s minimum wage for full-time work to meet this initial requirement of the exemption test. As of January 1, 2024, employees in California must earn an annual salary of no less than $66,560 to meet this threshold requirement. In 2023, the minimum wage is $15.50 for all employees regardless of employer size. 


One of the protections of the minimum wage law is an annual review of the wage rate using the U.S. Consumer Price Index for Urban Wage Earners and Clerical Workers (U.S. CPI-W). The Department of Finance calculated that the U.S. CPI-W increased by 6.16 percent for the period from July 1, 2022, to June 30, 2023, compared to the prior 12-month period. The minimum wage increases each year by the lesser of 3.5 percent, and the rate of change in the averages of the two most recent U.S. CPI-W, unless those averages are negative. If the averages are negative, there is no change in the minimum wage for the following year. 


On July 31, 2023, Governor Newsom certified the minimum wage increase for all employers for 2024. Employers must post the Minimum Wage Order and the Wage Order applicable to their workplace at a worksite area accessible to employees. The wage orders can be downloaded and printed from the workplace postings page on the DIR website. Employers must ensure that the wage rate is displayed on the employee’s pay stub, and that employees are paid at least the minimum wage even when employees are paid at piece rate. The Get Connected Electric Vehicle Report for the second quarter summarizes EV sales and purchasing trends across all 50 states. Tips for Navigating the Newly Released U.S. Citizenship & Immigration Services Agency Form I-9


I know there’s a new Form I-9 to verify eligibility to work in the United States. When do I need to start using it and what specific changes should I be paying attention to? The new Form I-9 was released by the U.S. Citizenship and Immigration Services agency (USCIS) on August 1, 2023, and employers must begin using the new version no later than November 1, 2023. Note that there is no need to complete new forms for current employees simply because an updated form has been issued. The Card Brands have announced the following important updates that may impact your merchant account programs. Effective January 1, 2024, Visa will start assessing a $0.10 fee for any contactless transactions received via Magnetic Stripe designation, which was discontinued in October, 2019.
