The President’s FY 2022 Discretionary Budget Requests a Historic Increase for the Department of Education
How historic? $29.8 billion representing a 41% increase!


The description for the Department of Education (ED) programs is on numbered pages 7-8, Department of Health and Human Services (HHS) is on pages 10-15, and Department of Labor is on pages 23-24. 

This topline request doesn’t include detail for some of the smaller agencies and programs we follow. There are still very few programs where we know the precise FY 2022 request; that detail is expected after the Administration releases its full FY 2022 budget later this spring, likely in May.
Legislative Advocacy
The U.S. Department of Education has released:

Guidance on Maintenance of Effort (MOE) Requirements and Waiver Requests under the Elementary and Secondary School Emergency Relief (ESSER) Fund and Governor’s Emergency Education Relief (GEER) Fund.
This guidance document includes the following:

  • A chart outlining the main similarities and differences between the MOE requirements in the Coronavirus Aid, Relief, and Economic Security Act (CARES Act), the Coronavirus Response and Relief Supplemental Appropriations Act, 2021 (CRRSA Act), and the American Rescue Plan Act of 2021 (ARP Act).

  • Frequently asked questions about the MOE requirements and the process for states to request a waiver under Section 2004(a) of the ARP Act. The Department’s approach to waiver requests will be rooted in consideration of the impact on students. The purpose of ESSER I, ESSER II, GEER I, GEER II, ARP ESSER, and Emergency Assistance to Non-Public Schools (EANS) Program funds is to expand resources for K-12 and postsecondary schools and students, not to replace existing state commitments to K-12 and postsecondary education.

  • A MOE worksheet describing how to calculate MOE under the CARES Act, the CRRSA Act, and the ARP Act.

  • The MOE submission form that each state must use to report MOE data for the CARES Act, the CRRSA Act, and the ARP Act.

  • The MOE request form that a state must use when requesting a waiver of the MOE requirements.

Magdalena Ojeda is currently serving as a high school assistant principal at South Texas ISD. Maggie just transitioned from supporting educators as a learning resources integration specialist at Region 1 ESC in Edinburg, Texas in which she had the opportunity to grow services to assist the local area in impacting teaching and learning with technology. She has served in public education for 20 years in such roles as an elementary teacher, technology integration specialist, college readiness supervisor, A.V.I.D. director, and English language arts-reading specialist. She has conducted STEM camps for 6th-12th grade levels and has pioneered e-sports in education in the Rio Grande Valley region.
