OSHA Issues Advisory Workplace COVID-Safety Guidelines |

The Occupational Safety and Health Administration (OSHA) has prepared this guidance for planning purposes. Employers and workers should use this guidance to help identify risks of being exposed to and of contracting COVID-19 in workplace settings and to determine any appropriate control measures to implement.
This guidance is not a standard or regulation, and it creates no new legal obligations. It contains recommendations as well as descriptions of existing mandatory safety and health standards. The recommendations are advisory in nature, informational in content, and are intended to assist employers in recognizing and abating hazards likely to cause death or serious physical harm as part of their obligation to provide a safe and healthful workplace.

CDC Requires Wearing of Face Masks While on Public Transportation and at Transportation Hubs |

According to a Jan. 29 press release, CDC is implementing provisions of President Biden’s Executive Order on Promoting COVID-19 Safety in Domestic and International Travel and will require the wearing of masks by all travelers into, within, or out of the United States, e.g., on airplanes, ships, ferries, trains, subways, buses, taxis, and ride-shares.
The release further states that the mask requirement also applies to travelers in U.S. transportation hubs such as airports and seaports; train, bus, and subway stations; and any other areas that provide transportation. Transportation operators must require all persons onboard to wear masks when boarding, disembarking, and for the duration of travel. Operators of transportation hubs must require all persons to wear a mask when entering or on the premises of a transportation hub.

Similarly, keep in mind that the Transportation Security Administration (TSA) has been authorized to fine passengers who fail to comply with the new mask requirements on public transportation systems.

Chapter Issues Memo in Opposition to Proposed Wage Theft Bill |
|
The ABC Empire State Chapter issued a memo in opposition to a proposed wage theft bill. The bill creates a new private right of action and requires direct contractors to pay any wages, fringe benefits, or other benefit payments or contributions owed by a defaulting subcontractor and is deeply flawed. The bill assumes that all general and subcontractors willfully and knowingly defraud their workers of wages and benefits. In essence, you’re guilty as charged and have little ability to defend yourself. What the bill needs to acknowledge and define are the good faith efforts of all contractors to ensure their workers receive the proper wages and benefits in what many will agree is a complicated and confusing set of rules and laws that govern prevailing wage work. |

Deadline Looms for Construction Worker Safety Training
The dramatic drop in construction related injuries demonstrates how a commitment to safety by the Department of Buildings and the contractor community is paying huge dividends,” said Brian Sampson, President of the Associated Builders and Contractors, Empire State Chapter. “With the SST deadline just 30 days away, we encourage all contractors to take advantage of the time and get their employees fully trained. ABC Signs onto Coalition Letter to Congress
ILR sent a coalition letter to Congress urging members to consider including targeted and temporary liability protections in the next COVID relief package. The letter points out that as the Biden Administration strives to reopen schools, protect our nation’s health and strengthen our economy, liability protections will help safeguard educational institutions, healthcare providers, businesses and non-profit organizations from unfair lawsuits.
