Contracts Changes
New Minnesota laws are going to change construction relationships and have required us to update AGC-MN’s form construction contracts. These new contract provisions, we believe, are the first-ever terms to address the new Wage Theft, Buy American, IRA, Cannabis, Indemnification, and other laws.
Members and non-members who purchased a license can download the contracts from the website and review or use them as soon as they are posted. The old versions of the contracts that do not address the new laws have been removed from the AGC website, and new contracts will be uploaded early next week.
Further details on the contracts and licensing are available on our website. Going forward, anyone who uses AGC-MN’s contracts should use the new versions.
AGC-MN’s contracts committee is a balance of in-house and outside lawyers, general and subcontractors, and business officers. The short form contracts are designed to represent the industry by being balanced, fair, and easy to use.

Cannabis Law
Although AGC-MN still believes that all jobs on the construction jobsite are safety sensitive and employees may be subjected to testing for cannabis (as they were before the new law), we now recommend that contractors update their drug policies and employee handbooks to explain this policy. Municipal CMAR Contracting Comes to Minnesota
The 2023 Minnesota Legislative Session wrapped up in late May with a flurry of consequential new laws. Among the bills that passed during the last week of the session was an amendment that will allow municipalities to use Construction Manager At-Risk contracting on many public works projects. AGC 2023 DEI Awards
Applications for the second annual AGC DEI Awards are now open! These awards recognize member businesses for their initiatives in the diversity, equity, and inclusion space, and are presented in four categories:
All applicants must be members in good standing with AGC of Minnesota for at least one year, and must sign the Culture of CARE Pledge. Submissions must relate to activities or initiatives conducted in the past 12 months.
Entries are judged by the AGC of Minnesota Diversity & Inclusion Judging Committee, based on the information provided in the application. Judges are non-members who are business owners, or work in educational institutions, government entities, and community-based organizations that work in tandem with the construction industry.
The 2023 Awards will be presented at the AGC Honors event on January 16, 2024 | St. Paul Event Center

DEI Leadership Council July Meeting
Our DEI Chair, Foster Hackett III, President of Advanced Design Contracting, hosted our July DEI Leadership Council Meeting last week. Our guest presenters included affiliate members Union Bank & Trust and CLA. As a partnership, they provided an overview of their services and DEI commitment and strategies for working with diverse members. We were also able to wish Foster a very Happy Birthday!

CHASE Level 3 Project
Congratulations to Rachel Contracting and Parsons Electric on their CHASE Level 3 project at Lincoln Park in Duluth! This complete overhaul of the 37-acre park will include site removals, earthwork and grading, bituminous and concrete paving, stone wall restoration, site utilities, landscaping, and park furnishings.

MnDOT RFQ
MnDOT has released a Request for Qualifications for the SP 8816-3427 Statewide Pedestrian Bridge Improvement project.
This advertisement period will be kicking off quickly with:
- A kickoff meeting on Thursday, August 10 at 1:00 pm. A link to the virtual meeting is provided in the RFQ document.
- SOQ submittal due on September 1, 2023
- Letting on January 10, 2024.
If anyone has questions about the project please ask them at the kickoff meeting or use the clarification process in the RFQ (and the form here).
The project website has been updated with repair recommendations for the four structures that will comprise the final project.

Minnesota Drought Update
Drought conditions in Minnesota continued to intensify over the past week. The Minnesota DNR continues to carefully monitor the situation and take steps as outlined in the Minnesota Statewide Drought Plan.
Key Points:
- The Mississippi Low Flow Management Plan for dam operation has been enacted.
- Four watersheds have moved to the Drought Warning Phase (Mississippi Headwaters, Upper Mississippi Black Root, Upper Mississippi Iowa Skunk Wapsipincon, and Upper Mississippi Maquoketa).
- One watershed remains in the Drought Warning Phase (St. Croix) and seven remain in the Drought Watch Phase.
- Surface water appropriation permits are under review in watersheds having recently reached critically low flows
The weekly U.S. Drought Monitor map released Thursday, August 3 shows that all of Minnesota is experiencing abnormally dry and/or moderate drought conditions, with areas of severe and extreme drought expanding in north-central and south-eastern Minnesota.
