12/22/2021
Dear Members,

Beginning next Monday, December 27, 2021, all workers in New York City who perform in-person work or interact with the public in the course of business beyond a quick and limited purpose will be required to show proof of their first dose of the COVID-19 vaccine.

Although buses are not specifically mentioned in this mandate, it is very broad. Therefore, we are making you aware of this after reviewing the information currently available which does pertain to vehicles in the five boroughs of New York City.

The Commissioner of the NYC Department of Health and Mental Hygiene (DOHMH), signed an order on December 13, 2021 to require the COVID-19 vaccination in New York City workplaces. The order reads:

“Beginning December 27, workers in New York City who perform in-person work or interact with the public in the course of business must show proof they have received at least one dose of a COVID-19 vaccine. Workers will then have 45 days to show proof of their second dose (for Pfizer or Moderna vaccines). Businesses may not allow any unvaccinated workers to come to their workplace. A workplace is considered any location — including a vehicle — where you work in the presence of at least one other person.”

This vaccine mandate applies to all private-sector workers in New York City, including independent operators. This includes for-hire vehicles. The guidance indicates that inspectors from different agencies will be inspecting for compliance starting December 27, 2021. If a business refuses to comply with the mandate, they are subject to a fine of $1,000 and escalating penalties thereafter if violations persist.

The vaccine mandate has limited exceptions, only workers who are granted a reasonable accommodation are exempt from providing proof of vaccination. If a worker has a reasonable accommodation, the employer must maintain a record of the stated basis for such accommodation and any supporting documentation. If a worker needs to apply for a reasonable accommodation they must do so before December 27, 2021. Reasonable accommodations may be granted for medical or religious reasons.
