AmeriHealth Caritas and Southeastrans would like to provide you with the formal escalation process for your information.
Dispute Resolution:
a. Any controversy or claim arising out of or relating to this Contract (or the breach thereof) which cannot be resolved through good faith negotiations shall be settled by arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Any judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The parties agree to provide Prime Contractor(s) with notice of any dispute submitted to arbitration. No dispute shall disrupt or interfere with the provision of services to a Member or Prime Contractor(s).
b. The prevailing party in any proceeding to resolve a dispute or to enforce its rights under this Contract shall be entitled to receive its reasonable attorney fees and related out-of-pocket costs and expenses related to such proceeding in addition to any other relief it may be awarded.
