Macomb County Prosecutor’s Office Collaborates with U.S. Attorney’s Office in Charging Former Warren Police Officer Matthew Rodriguez with Civil Rights Violation Charge

On Tuesday, June 13, 2023, Jaquwan Smith was arrested and lodged at the Warren Police Department for an alleged crime where he was charged with armed robbery (life felony), carrying a concealed weapon (five year felony), felony firearm (two year mandatory felony), assaulting / resisting / obstructing a police officer (two year felony), and breaking and entering a vehicle to steal property less than $200 (93-day misdemeanor).  When Smith was being fingerprinted, it is alleged Warren Police Officer Matthew Rodriguez assaulted Smith while Smith was in his custody.

Macomb County Prosecutor Peter J. Lucido charged Matthew Rodriguez, age 48, with Wilful Neglect of Duty (one-year misdemeanor) and Assault and Battery (93 day misdemeanor), the maximum which could be charged under Michigan law.

Prosecutor Lucido joined United States Attorney for the Eastern District Dawn Ison and U.S. Department of Justice Acting Special Agent in Charge Devin J. Kowalski for a press conference at the United States Attorney's Office in downtown Detroit. U.S. Attorney Dawn Ison announced charges against former Warren Police Officer Matthew Rodriguez with a civil rights violation in connection with a Tuesday, June 13, 2023 incident at the Warren Police Department involving a man in Rodriguez's custody.

The U.S. Attorney's Office for the Eastern District through U. S. Attorney Dawn Ison, has charged Matthew Rodriguez with a ten-year civil rights violation of 18 U.S.C. § 242 (Deprivation of Rights Under Color of Law). The Macomb County Prosecutor’s Office has now deferred to the U.S. Attorney for the Eastern District of Michigan to prosecute this case as the federal system has a legal mechanism for civil rights violations and its penalties.

“Collaboration between my office and the U.S. Attorney’s Office in this case is necessary in holding accountable those who trample upon the rights of others. With our collective efforts and determination for change, we confront injustice,” said Macomb County Prosecutor Peter J. Lucido

The Macomb County Prosecutor’s office represents the people. We are committed to achieving justice and following the laws of the State of Michigan. All that are accused of a crime are presumed innocent until proven guilty in a court of law.

Macomb County Prosecutor’s Office Third in Nation for Criminal Justice and Public Safety Achievement Awards

The Macomb County Prosecutor's Office, under the leadership of Prosecutor Peter J. Lucido, has once again demonstrated its commitment to excellence by receiving an impressive seven Achievement Awards from the National Association of Counties (NACo) in the category of Criminal Justice and Public Safety. This outstanding achievement places the office among the top performers nationwide and solidifies its reputation as a leader in the field, according to a review of the NACo website.

With a total of 3,142 counties across the 50 states, winning an NACo Achievement Award is a rare distinction. Only 5% of the counties receive this prestigious recognition, highlighting the exceptional accomplishments of the Macomb County Prosecutor's Office. Furthermore, Macomb County's position within the top 20 recipients puts it in the top 1% of all counties and secures its third-place ranking for the number of awards in the category of Criminal Justice and Public Safety.

The NACo Achievement Awards recognize county government innovations that enhance services for residents. The Macomb County Prosecutor's Office has been recognized for its forward-thinking initiatives that have transformed the delivery of justice and public safety in the community.

The seven initiatives honored with NACo Achievement Awards in the category of Criminal Justice and Public Safety are as follows:

  • Death case dashboard improves administration of cases involving death.

  • Paperless victim rights requests improve service.

  • Payment processing tech improves criminal case "discovery digital media fee" processing.

  • Prosecutor converts digital evidence platform to staff training platform.

  • Prosecutors streamline access to justice with electronic victim advocate assistance requests.

  • Technology pushes instant warrant and courtroom manual updates to assistant prosecutors.

  • Weekend warrant authorization improved with jail duty tracker.

"Receiving seven Achievement Awards from the National Association of Counties is an incredible honor and a testament to the dedication of our team. We are proud to be recognized among the top performers in the nation, placing Macomb County in the top 1% and ranking third in the category of Criminal Justice and Public Safety. These awards validate our commitment to innovation, service, and excellence as we continue to implement groundbreaking programs that positively impact our community. We will continue to strive for greatness and deliver the highest standards of justice for the residents of Macomb County,” said Macomb County Prosecutor Peter J. Lucido.

More Macomb County Prosecutor's Office Improvements

The programs recognized by the NACo Achievement Awards are not the only improvements Prosecutor Lucido has made since January 2021. In addition to successfully prosecuting crimes throughout the county, other progress includes:

  • Hate Crimes Unit Launched: Prosecutor Lucido recognized that Hate Crimes in Macomb County were likely under-reported. Prosecutor Lucido created the Hate Crimes Unit and began to educate police agencies and the public on what constitutes a Hate Crime, and provided focused prosecutorial resources to charge and try these crimes. According to FBI statistics, there has been over a 50% increase in the reporting of hate crimes in Macomb County in the first two years of Prosecutor Lucido’s administration versus the three years prior to him taking office.

  • Child support collections increased. Prosecutor Lucido’s office increased focus to collect child support from parents who owe $5,000 or more. Thanks to support from the County Commission and County Executive, the office collected over $100,000 so far this year for the direct benefit of Macomb County children.

  • Mental health assessments sought as a condition of bond in gun crime cases. With this first-in-Michigan policy to seek mental health assessments as part of bond in all gun crime cases, Prosecutor Lucido recognizes that some defendants struggle with mental health issues, which might be addressed through early identification and provision of appropriate services before defendants get an opportunity to commit another crime with a gun.

  • School threats are taken seriously. Prosecutor Lucido has authorized several school threat cases. "We promise to prosecute every one of these threats," said Lucido.
  • Conviction Integrity Unit exoneration. This unit investigates claims of innocence to determine whether there is clear and convincing new evidence that the convicted defendant was not the person who committed the offense and to review claims of factual innocence based on new evidence. Thanks to support for this unit from the County Commission and County Executive, a person was exonerated this year.

CIU Chief Gail Pamukov, exoneree Mack Howell, and Macomb County Prosecutor Peter J. Lucido

  • Major Crimes Unit launched: Prosecutor Lucido organized the top-ranked assistant prosecutors to focus on major crimes, and train more APAs to handle these types of cases.

  • Warrant Appeals Unit launched: Victims and law enforcement officials are now given the right to have a second set of eyes to review cases where charges are denied, the first known unit of its kind in the state.

  • Digital Evidence Management platform implemented. With more than 400,000 pieces of digital evidence in the system, the volume of digital evidence is higher than it’s ever been, and keeps increasing. Police agencies now upload digital evidence, the Prosecutor’s Office reviews it, and defense lawyers can directly download the evidence.
  • More interns equals more justice. Prosecutor Lucido hosted over 200 law school and college interns so far! Michigan Court Rules allow law students this exciting opportunity to handle court hearings under supervision, which helps the office move cases forward more quickly.

  • Paperless crime victim rights. Prosecutor Lucido implemented the county’s first paperless system for crime victims to request rights and notification. Crime victims may now request victim information via text message, or entirely online via the Prosecutor’s Office Website.

  • Providing police training. Prosecutor Lucido regularly sends assistant prosecutors to every police agency in Macomb County to provide training, including updates on recent court cases.

Macomb County Prosecutor’s Office Digital Evidence Library Continues to Grow

Digital evidence management platform launched last year by Macomb County Prosecutor Peter J. Lucido already contains over 440,000 items of digital evidence.  Prosecutors are legally required to share digital evidence with the defense.  This important process is now more efficient with the Macomb County Prosecutor’s Office technology.

Defense attorneys may request discovery on the Macomb County Prosecutor’s website or by texting “discovery” to 586-250-4090.

The Prosecutor’s Discovery Unit routinely provides discovery within a few business days of a request.  The Prosecutor’s Office has never provided discovery this quickly this long.  A system called Evidence.com eliminated the need for defense attorneys to physically retrieve evidence. With a simple download link, discovery is shared securely, ensuring that all evidence remains protected. This innovative system not only streamlines the process of discovery but also provides an audit trail, tracking who receives the evidence and when. Discovery is one of many things we are improving about our Prosecutor’s office.

Update on Peanut the Prosecutor

Peanut is continuing to "study" for his test. He has done well overall and continues to make progress toward the goal of sitting still in the down position while in court for one full hour even if there are distractions around.

He LOVES to come to work (usually 3 days a week) and absolutely loves his celebrity status in Macomb. He greets everyone with a sniff and a large eyed look. He has LOADS of hair, so you will have some mementos on your clothing afterward. The canine advocacy unit appreciates your support!

Prosecutor Lucido's Gun Violence Policy

The Macomb County Prosecuting Attorney Peter J. Lucido has implemented a gun crime policy with the primary goal of reducing gun related crimes in the community. This policy aims to hold defendants accountable for illegally possessing guns, and addresses the important issue of mental health.

Police have expressed that the prevalence of guns is making every encounter they make more dangerous; and that this stricter stance will increase the chances to protect law-enforcement personnel and the community, and attempt to reduce gun crime recidivism.

Assistant prosecuting attorneys have limited discretion to reduce charges in any gun-related case. Furthermore, the Macomb County Prosecutor’s office will ask the court to order a mental health screening and assessment as a condition of bond in all gun cases.

Prosecutor Lucido Discusses Elder Abuse Charges

A Macomb County woman accused of torturing boyfriend's elderly mother - Prosecutor Peter J. Lucido discussed charges of elderly abuse with Fox 2's Charlie Langton.

This is one of the most horrific cases the Prosecutor's Office has seen. Unfortunately, the Prosecutor's Office is seeing more and more elder abuse cases. As a society, it is near impossible to comprehend that others would harm elderly people, the members of the Greatest Generation. We are taught to take care of those who took care of us. We are taught to respect our elders and look after them. See below for more information on this case.

Anyone suspecting that a vulnerable adult has been abused, neglected, or exploited may report his or her suspicions to the Adult Protective Services Unit of the Department of Human Services by calling 855-444-3911, 24 hours a day, 7 days a week. Aside from contacting Adult Protective Services, anyone suspecting that a vulnerable adult has been abused, neglected, or exploited should also contact their local police department and file a police report immediately. If in doubt, remember that it is better to err on the side of caution. Failure, or delay, in making the call could cost a vulnerable adult more than their life savings; it could cost them their life. Information on Elder Abuse.

Suspect in murder of two year old Wynter Smith from Lansing charged in connection with fleeing police

On July 7, 2023, a 26 year old man was charged in connection with fleeing from police after an alleged vicious assault, kidnapping, and murder.

It is alleged that on Sunday, July 2, 2023, Rashad Trice assaulted his ex-girlfriend, kidnapped her two year old daughter, and drove away in the mother’s car in Ingham County. An amber alert was issued. Early Monday, July 3, 2023, St. Clair Shores police attempted a traffic stop and Trice fled at a high rate of speed. After colliding with a police vehicle, Trice’s car was disabled. When officers tried to get Trice out of the vehicle, he grabbed at an officer’s gun, and resisted arrest but was eventually taken into custody. The little girl was found dead in Detroit on the evening of Wednesday, July 5, 2023.

In Macomb County, Rashad Trice is charged with Fleeing and Eluding in the Third Degree (five-year felony), Attempt to Disarm an Officer (five-year felony), Receiving and Concealing a Motor Vehicle (five-year felony), Assault with Dangerous Weapon (five-year felony), Resisting and Obstructing Causing Injury (four-year felony) and three counts Resisting and Obstructing a Police Office (two-year felonies). He will be arraigned in Macomb County at an undetermined date and time. Trice was arraigned in Ingham County on multiple charges and remains in jail without bond.

“Tragically, this case has taken a heart-wrenching turn, as we must now face the devastating reality that the little girl, a precious life with endless potential, was brutally taken away. The alleged events that transpired in our neighbor county are heinous actions. The relentless efforts of all law enforcement including the St. Clair Shores and Eastpointe police departments led to the eventual capture of the defendant. However, the apprehension did not come without difficulty, as he actively evaded his capture and ultimate arrest, displaying a complete disregard for the lives and safety of others. The defendant's resistance and attempts to elude justice only compound the severity of his crimes,” said Macomb County Prosecutor Peter J. Lucido. More information
