WHAT'S SELLING AT THE BLUFFS-NOVEMBER 2020                                        
Recent Sales Update
Below is a year to date comparison of closed sales comparing the first 10 months in 2019 to 2020.  The Ocean North has seen the largest increase (over 400%) in the number of sales, mostly due to the building and balocony restoration project  being completed this year. 

The Ridge at the Bluffs - 25 homes sold year to date compared to 24 homes sold in the same period of 2019. Sales prices range this year from $450,000 to $760,000.
The River - 17 homes sold year to date compared to 20 homes sold in the same period of 2019. Sales prices ranged from $501,000 to $810,000 for non-intracoastal properties and two sales on the Intracoastal went for $1,280,000 and $1,550,000.

The River North - 11 townhomes sold year to date compared to 15 townhomes sold in the same period of 2019. Sales prices range this year from $255,000 to $330,000.

The Lakes at the Bluffs - 17 townhomes sold year to date compared to 21 townhomes sold in the same period of 2019. Sales prices range this year from $252,000 to $362,500.

The Marina at the Bluffs - 29 condos sold year to date compared to 30 condos sold in the same period of 2019. Sales prices range this year from $310,000 to $498,500.
The Ocean South - 5 condos sold year to date compared to 9 condos sold in the same period of 2019. Sales prices range this year from $311,000 to $465,000.

The Ocean North - 14 condos sold year to date compared to 3 condos sold in the same period of 2019Sales prices range this year from $270,000 to $550,000.

How can I cancel a real estate contract?

The answer is, it depends.  It depends on what the Contract for Sale and Purchase allows.

A commonly used contract form in Palm Beach County is the Florida Realtors/Florida Bar "As Is" Residential Contract for Sale and Purchase (the "Contract").  Paragraph 12(a) of the Contract, titled "Property Inspection; Right to Cancel," states:
 
Buyer shall have ___ (if left blank, then 15) days after Effective Date ("Inspection Period") within which to have such inspections of the Property performed as Buyer shall desire during the Inspection Period.  If Buyer determines, in Buyer's sole discretion, that the Property is not acceptable to Buyer, Buyer may terminate this Contract by delivering written notice of such election to Seller prior to expiration of Inspection Period.  If Buyer timely terminates this Contract, the Deposit paid shall be returned to Buyer, thereupon, Buyer and Seller shall be released of all further obligations under this Contract. . . . Unless Buyer exercises the right to terminate granted herein, Buyer accepts the physical condition of the Property and any violation of governmental, building, environmental, and safety codes, restrictions, or requirements, but subject to Seller's continuing As IS Maintenance Requirement, and Buyer shall be responsible for any and all repairs and improvements required by Buyer's lender. [Emphasis added].
 
The Buyer's right to cancel is clear and unequivocal.  The Buyer can cancel at his or her "sole discretion" and the Buyer's deposit is fully refundable.  Although clear on its face, this clause is the source of much legal wrangling.  Buyers need to be timely with their written notice.  And, Buyers must be clear and concise in their termination language.
 
A Buyer that makes a termination of contract contingent on Seller making a small repair has been held to be ineffectual as a termination under paragraph 12(a).  What seems like a straightforward clause often causes much confusion, consternation, and even litigation.
 
In addition to the Buyer's absolute right to cancel contained in the inspection clause, there are several other contingencies that may allow a Buyer or Seller to cancel the Contract under certain circumstances, such as the financing contingency and the title/survey defect provisions.
 
Bottom Line: A Buyer has the absolute right to cancel the Contract within the inspection period if the cancellation is made timely and unequivocally.  If, as a Buyer, you find that you want to terminate a Contract outside of the inspection period, there are other provisions in the Contract that may provide relief, depending on your particular circumstances.
