One of the legislative items that NC DHHS had hoped to pass this session was a bill that would have provided them authority to move forward with the Child and Family Specialty Plan. Companion bills, House 144/ Senate 146, was introduced that directed DHHS to implement the Specialty Plan. The bill passed the Senate but then stalled in the House and session ended without the passage of a bill that would grant DHHS to move forward with the plan. The bill stalled in the House is because of concerns raised by the LME/MCOs about removing this population from under their plan. 

The LME/MCOs began working on creating a Child and Family statewide model that would allow the LME/MCOs to serve this population, as an alternative to the DHHS statewide plan that would be bid out to one statewide provider. In the statewide model, the LME/MCOs have proposed a plan that would provide consistent and seamless care across all 6 of their catchment areas. NC DHHS is still committed to a statewide specialty plan and will be pursuing legislation in the long session, starting in Jan 2023.

Integrating Community Health Workers into NC Medicaid

The North Carolina Department of Health and Human Services (NCDHHS) has long held a vision that Community Health Workers (CHWs), and other extenders, can play important roles in improving health. CHWs serve as important, trusted connectors to the community and propel equitable health outcomes. As the CHW workforce grows in North Carolina, NCDHHS seeks to emphasize the ways CHWs can be leveraged to improve health and health care for individuals enrolled in Medicaid.

NCDHHS plans to release managed care guidance later this year describing NCDHHS’s strategy to further integrate CHWs into NC Medicaid. This will include opportunities for stakeholder input and feedback to inform the strategy.

In the interim, the guidance document provides important overarching information on CHWs to encourage broader use of CHWs in Medicaid. It summarizes the definition of a CHW, offers examples of how CHWs can serve Medicaid members, and provides information on current CHW training and certification opportunities in North Carolina.

988 National Suicide Prevention Lifeline and Behavioral Health Response Goes Live Tomorrow
Beginning July 16, 988 will become the new three-digit number for the National Suicide Prevention Lifeline.

The Lifeline will provide compassionate, accessible care and support via phone, text, or online chat to anyone experiencing mental health-related distress. You can use 988 if you have thoughts of suicide, mental health or substance use crises, or any other kind of emotional distress. You can also dial 988 if you are worried about a loved one who may need crisis support.

Additionally, many women feel overwhelmed, sad, or anxious during their pregnancy and even after the baby is born. For some women, these emotions may stay for months.

The Health Resources and Services Administration (HRSA)’s new National Maternal Mental Health Hotline provides real-time emotional support, encouragement, information, and referrals. Pregnant and postpartum women can call or text 1-833-9-HELP4MOMS (1-833-943-5746) to get the help and resources they need when they need it.

Joint Communication Bulletins

JCB #422: Extension of COVID-19 Flexibility for Opioid Treatment Programs (OTP) Take-Home Dosing
This bulletin provides an update on the OTP Take-Home dosing COVID-19 flexibility extension based on the exemption from the Substance Abuse and Mental Health Services Administration (SAMHSA). With this exemption, the Division of Health Benefits (DHB) will allow for the following provision and billing for TakeHome doses provided by OTPs until July 15, 2022:

  • Stable patients in an OTP may receive 28 days of take-home doses of the patient’s medication for opioid use disorder.
  • Up to 14 days of take-home medication for those patients who are less stable but who the OTP believes can safely handle this level of Take-Home medication.

It remains within the OTP provider’s discretion to determine the number of take-home doses within each category of ‘stable’ or ‘less stable’. The provider is still responsible for determining the amount of take-home doses that an individual can safely manage.

This decision-making and discussions must be documented in the
individual’s medical record consistent with 42 C.F.R. § 8.12(i)(3).
Further guidance will be forthcoming regarding the possibility of extending this exemption.

JCB #423: Placement of Minors in Unlicensed Alternative Family Living Homes (AFLs)
This bulletin serves to reiterate laws and rules governing both the operation and provision of services within a licensable facility as outlined in Joint Communication Bulletin #J244.

The NC Department of Health and Human Services (DHHS) received notification that LME/MCOs may be participating in the coordination of placement for minor children and adolescents in unlicensed Alternative Family Living Homes (AFLs). Engagement in this practice must cease as it violates the laws and rules governing licensure of facilities.

The following is a summary of the main statutes and rules that require an AFL to be licensed if it is providing services to one or more minors or to two or more adults.
  1. N.C.G.S. § 122C-3(14) defines a “licensable facility” as “a facility for one or more minors or for two or more adults that provides services to individuals who have mentally illness or intellectual or other developmental disabilities, or substance abusers. These services shall be day services offered to the same individual for a period of three hours or more during a 24-hour period, or residential services provided for 24 consecutive hours or more. Facilities for individuals who are substance abusers include chemical dependency facilities.”
  2. N.C.G.S. § 122C-21 states the purpose of the licensure laws. The purpose of the licensure laws and rules is to provide for licensure of facilities for individuals with mental health disorders, developmental disabilities, and substance use disorders by the development, establishment, and enforcement of basic rules governing the provision of services to individuals who receive services from licensable facilities and the construction, maintenance, and operation of these licensable facilities that, based on existing knowledge, will ensure safe and adequate treatment of these individuals.
  3. N.C.G.S. § 122C-23(a) states “No person shall establish, maintain, or operate a licensable facility for individuals with mental illness, individuals with intellectual or other developmental disabilities, or substance abusers without a current license issued by the Secretary.”
  4. 10A NCAC 27G .5601(a) defines “Supervised living” as “a 24-hour facility which provides residential services to individuals in a home environment where the primary purposes of these services is the care, habilitation, or rehabilitation of individuals who have a mental illness, a developmental disability or disabilities, or a substance abuse disorder, and who require supervision when in the residence.”
  5. 10A NCAC 27G .5601(b) requires that a supervised living facility “be licensed if the facility serves either: (1) one or more minor clients; or (2) two or more adult clients.”
  6. N.C.G.S. § 122C-28 states: “Operating a licensable facility without a license is a Class H felony, including a fine of one thousand dollars ($1,000) per day that the facility is in operation in violation of [Article 2 of Chapter 122C of the General Statutes].”

In summary, an AFL must be licensed if it serves one or more minors or two or more adults. If LME/MCOs are engaging in the coordination of care and payment of placement in unlicensed facilities that do not meet licensing requirements as written in the statutes and rules, this practice must cease immediately to protect client safety and ensure adequate treatment.

Additional Electronic Visit Verification Data Capture
Effective July 31, 2022, NCTracks will capture additional Electronic Visit Verification (EVV) data from NC Medicaid’s EVV vendor, Sandata. EVV data capture will be expanded to include Bill Time and Pay Time for applicable claims to determine the applicable Personal Care Services (PCS) code units. NCTracks will capture and store these additional fields.

Resolution of Prior Approval Issue for Outpatient Specialized Therapies
On June 26, NCTracks began modifying the end date in prior approval (PA) requests for beneficiaries who have transitioned from Medicaid Direct to Managed Care. In eligible PA records for beneficiaries three years of age and older, the end date is modified to align with the end date of the beneficiary’s Medicaid Direct eligibility. For records with modified end date, a notification is issued to the billing provider via the NCTracks Message Center to inform the provider of the date change. 
 
As previously announced, NCTracks incorrectly modified prior approval records for beneficiaries who are two years of age as of the approved PA begin date. As of July 6, NCTracks has corrected all impacted PA records with end date and status returned to the original date and status.

This new episode of the Medicaid Leadership Exchange podcast explores the inner workings of Medicaid’s workforce recovery and the opportunity to build a more diverse, equitable, and inclusive work culture.

Hazard Pay, Paid Sick Leave & Direct Care Workers
Our new study shows that while 24 states and DC supported direct care workers with hazard pay and/or paid sick leave policies during the first 18 months of COVID-19, 26 states did not.

During 2021, with help from our partner, The John A. Hartford Foundation, we worked to support the nation’s direct care workforce.

WHQR: Community Child Protection Team says there's room for improvement in New Hanover County child welfare
Earlier this week, the New Hanover County Board of Commissioners heard a presentation on some of the challenges involving child protection in the county.
The Community Child Protection team, or CCPT, is made up of community members working under the state's Department of Health and Human Services. Individual teams focus on the problem of child abuse and neglect in a particular county.

While the team has had some success over the last year, Neesha Allen, Co-Chair of the CCPT, noted areas in which the county is lacking.

“The lack of consistent, accessible, effective Mental Health and Developmental Disability Services has been something that we have concentrated on," she said.

Allen said it’s hard to access therapeutic placement and inpatient and psychiatric residential treatment for children. Another issue is that when the Department of Social Services or DSS takes children away, their parents lose Medicaid benefits, meaning they cannot access critical services.

Chief Judge J. H. Corpening, who has presided over juvenile court for years, echoed several of the team’s recommendations for the county.

“So some of our recommendations in this category, including expanding private insurance coverage for mental health services, expanding state funding for mental health and developmental disability services. improve oversight of Medicaid providers by Trillium, some of that oversight has been challenging in the past, expanding capacity for therapeutic placements for children, children who need that extra level of care, like can't be kept waiting, and then approving Medicaid expansion.”

The Daily Advance: DHHS Findings Suggest Bertie DSS Director Acted Unlawfully
WINDSOR — A former social services director in Bertie County may have acted unlawfully when she, instead of a judge, signed temporary custody orders to remove children from their families.
The state Department of Health and Human Services took over administration of Bertie County Department of Social Services’ child welfare office in May.

Once there, state workers found an office in disarray, filled with untrained workers who didn’t understand state laws or policies, and a director who signed documents that one lawyer contacted by Carolina Public Press said were a violation of state law.

“There is a complete absence of leadership over child welfare services, starting with the BCDSS Director,” DHHS’ initial assessment of the county’s child welfare office said in a report authored last month.

In May, the state DHHS took the unusual step of taking over the child welfare office within Bertie County DSS.
Former Director Cindy Perry had worked in a variety of roles at Bertie County’s Department of Social Services since1990, working her way up from someone who verifies income of clients to a variety of social work positions.

County Human Resources Director Cortney Ward said the state Office of Human Resources found that Perry was qualified to be a director when she was hired to the position in 2016.

Perry’s retirement was effective July 1, according to a document signed by herself and County Manager Juan Vaughan II on June 24. Perry earned $84,547 per year. Two others have left the office since May: a social work supervisor and an income maintenance worker, county records show.

Bertie County is part of a wider judicial district in the eastern part of the state that includes Hertford, Northampton and Halifax counties. Social workers often traveled to those counties to ask judges to sign a nonsecure custody order.

Such orders are typically sought when there’s a “substantial risk of bodily harm or injury” to a child, said David Wijewickrama, an attorney who has represented families in Western North Carolina.
“The court will authorize a removal for a very short duration to set the matter for a hearing to determine the veracity of the allegations,” Wijewickrama said.

“DHHS also discovered that the director signed several nonsecure custody orders,” the DHHS assessment of the office said. “Only a judge or a judge’s authorized designee has the authority to issue a custody order for a juvenile.”

Wijewickrama said, “It is unlawful for a director to sign an order. … If a child is removed under a protective order that a director signs, it is not legally binding.”
