NCCOA Opinion Requires Parties To Sign Mediated Settlement Agreements To Be Enforceable
On November 3, 2020, the North Carolina Court of Appeals issued an opinion requiring the parties, and not the attorneys on behalf of the parties, to sign memoranda of settlement from mediations in order for the settlement to be enforceable. Please refer to the memorandum issued by the North Carolina Dispute Resolution Commission for more details - download memorandum.

To comply with this COA opinion, please make sure to obtain your client’s signature, rather than signing as their representative, on a memorandum of settlement at the conclusion of a successful mediation.
