California Supreme Court Rules It's Unconstitutional To Imprison People Just Because They Can't Afford Bail

Pretrial detention is supposed to be for people deemed dangerous, not people without money.

In a unanimous California Supreme Court decision, the state's top justices ruled Thursday that courts must consider a defendant's ability to pay bail before setting exorbitant demands that keep many people locked up in pretrial detention.

A fair and just pretrial release and detention system recognizes the presumption of innocence, facilitates due process, and serves to advance public safety for all. This is the fundamental premise underlying Proposition 25 on California’s Ballot in 2020 as it seeks approval to eliminate the monetary bail system which unfairly discriminates against people with mental illness and exacerbates socioeconomic and racial bias. Instead it would establish a risk-based system for pretrial release and detention.

Department of Health Care Services Notice of
Proposed Changes to CALAIM

The California Department of Health Care Services (DHCS) is providing public notice of its intent to (1) submit to the federal Centers for Medicare & Medicaid Services (CMS) an amendment and five-year renewal of California’s Section 1115 demonstration and a corresponding amendment and renewal expanding the existing Section 1915(b) waiver and (2) hold public hearings to receive public comments on these requests.
