U.S. Department of Labor: Davis-Bacon Act Rulemaking
On March 18, 2022, the United States Department of Labor (USDOL) Wage and Hour Division (WHD) issued a Notice of Proposed Rulemaking proposed to amend regulations issued under the Davis-Bacon and Related Acts that set forth rules for the administration and enforcement of the Davis-Bacon labor standards that apply to Federal and federally assisted construction projects.

The proposed rules would make significant changes to the Davis-Bacon Act (DBA) requirements on federally funded highway projects especially to application of the requirements to material suppliers and truck drivers. On May 16, 2022, the Illinois Asphalt Pavement Association submitted comments outlining industry concerns with these proposed rules. Comments were also submitted by other industry groups including the American Road & Transportation Builders Association, the Associated General Contractors of America, the Illinois Association of Aggregate Producers, the Illinois Professional Land Surveyors, the Illinois Road & Transportation Builders Association, the National Asphalt Pavement Association, and the Southern Illinois Builders Association.

The USDOL will now review the 40,941 comments submitted. Based on the comments USDOL, may issue the final rule as proposed, issue the final rule with changes based on comments, or issue another proposed rule for additional public comments. Providing that there are no legal challenges that delay implementation, the final rule would go into effect 30 days after it is issued.
