We heard thought-provoking remarks from Keynote Speaker Reuben Jonathan Miller, sociologist, University of Chicago assistant professor and author of Halfway Home: Race, Punishment and the Afterlife of Mass Incarceration. Trapeta B. Mayson, 2020-21 Philadelphia Poet Laureate, shared healing words of verse, including “In This Season” and “Superhero.” And we celebrated 47 Honorees, whose work collectively paved the way for LASP's service across 20+ years. Willilam L. Baldwin, LASP Board President and Delaware County Bar Association Executive Director, and C. Shawn Boehringer, LASP Executive Director, both shared brief remarks. Entertainment was provided by V. Shayne Frederick and the Charles Baldwin Experience.

Hurricane Ida insurance issues

Hurricane Ida insurance claims:
File a complaint with the PA Dept. of Insurance if you are having issues with your insurance company or public adjuster
MAPLE GLEN - At a May 5 community meeting, residents of Horsham and Upper Dublin townships discussed problems with insurance claims related to Hurricane Ida and the tornado that heavily damaged homes and businesses in their Montgomery County neighborhoods. The one-hour meeting was hosted by State Sen. Maria Collett, Rep. Todd Stephens, Rep. Ben Sanchez and the Upper Dublin Township Board of Commissioners at Maple Glen Elementary School in Maple Glen.

David Buono, Deputy Insurance Commissioner for Pennsylvania, gave brief remarks and asked the audience to share their problems with insurance claims. Residents spoke openly about disputed claims and delayed payments, leaving them with an unclear path forward while waiting for insurance payouts. Some residents said they were receiving insurance payments of $10,000-$15,000 at a time on $400,000 claims, which they said were not substantial enough to rebuild and move on.

The Pennsylvania Dept. of Insurance asks residents who are having problems with insurance claims to file a complaint.

Consumer fraud alert
Zelle cash app scams have emptied clients' bank accounts
At a May 18 LASP Housing and Consumer Affinity Group meeting, LASP Staff Attorney Carolyn Johnson shared that she has seen an increase in problems with scams using the cash app Zelle. She has recovered some funds for clients. Carolyn noted that the app is offered through banks and credit unions. The LASP Consumer Affinity Group, consisting of staff attorneys and paralegals, exists to provide consumers with the tools to improve their financial well-being. The group brainstorms solutions and shares trends to strengthen LASP's response to emerging and ongoing legal issues in Bucks, Chester, Delaware and Montgomery counties.

The problems with Zelle have been noted in the New York Times, Forbes and other media outlets. In an April 26 New York Times article titled "Senators question Zelle over how it is responding to reports of rising fraud," reporters Lananh Nguyen and Stacy Cowley wrote, "In one common scam, attackers posing as bank fraud investigators fool victims into transferring money into thieves’ accounts. Banks often refuse to compensate the tricked customers because they view them as having approved the transfers."

Tips to avoid mobile payment app scams
The American Bankers Association Foundation and Federal Trade Commission provide the following tips for consumers who use mobile payment apps, including Zelle, Venmo, CashApp and others.

Avoid sending money to a scammer
  • Don't click on links in an unexpected email, text message, or direct message that asks you to send money. Don't give any personal or sensitive information like your username, PIN, or password.
  • Confirm that you know the person you're sending money to. 
  • When sending to someone you know, double-check their information before you hit send.
 
Protect your accounts
  • Use multi-factor authentication. This means you need two or more credentials to get into your account: your password plus something else like an authentication code or fingerprint.
  • Never share your credentials, like a verification code you get via text or authentication app.
  • Set up alerts in the payment app to get transaction notifications outside of the app environment, such as via email or text.
  • Regularly check your payment app and bank accounts to make sure no unauthorized payments have been sent from or accepted by your account.

Paid a scammer through a payment app?
  • Report it to the payment app or service and ask to reverse the transfer.
  • Tell your financial institutions.
  • Report it to the Federal Trade Commission at ReportFraud.ftc.gov.

Kesha James named new MIE Executive Director
Kesha James, LASP's Deputy Director for Advocacy through May 23, started June 1 as Executive Director of Management Information Exchange (MIE). LASP wishes her well and thanks her for her dedicated service!

As Deputy Director beginning in 2013, Kesha oversaw LASP's legal services delivery system and impact advocacy while supporting all aspects of senior management. As supervisor for LASP’s managing attorneys, she implemented substantive practice affinity groups and redesigned advocacy systems, while also implementing a robust, accredited CLE training program. Previously, she served as Pro Bono Director and staff attorney for LASP’s mortgage foreclosure and predatory lending prevention unit. 

In a farewell e-mail to LASP staff, she wrote, "I would like to thank everyone for 16 amazing years. Working with such wonderful colleagues makes the very challenging work that we do much more enjoyable. I am excited to begin a new chapter in my career as the Executive Director of Management Information Exchange, but I will truly miss LASP and everyone here. LASP has grown so much over the last few years. We have double the number of staff and offices, many new funders and programs, and we have expanded our work in several areas. I am so proud of what LASP has accomplished and the remarkable services you all work to provide day after day."

Montgomery Bar Foundation presents the 2022 Legal Aid Golf Classic! New time; new location
BLUE BELL - Registration is now open for the 2022 Legal Aid Golf Classic. The annual event will be held at a new location and time: Cedarbrook Country Club, 180 Penllyn Pike, Blue Bell, PA 19422. Shotgun start will be at 1:30 p.m., followed by a fundraising dinner at 6:30 p.m. featuring raffle prizes and a silent auction. There are a number of ways to support the cause: by golfing, attending the dinner, purchasing or selling raffle tickets, donating a prize to the raffle or silent auction, or becoming an event sponsor. Once again, proceeds will benefit Legal Aid of Southeastern Pennsylvania.

Letter from the PA Supreme Court
Chief Justice Max Baer on pro bono support for legal aid
In a May 16 letter to attorneys, Max Baer, Chief Justice of the Pennsylvania Supreme Court, wrote to celebrate PA's tradition of support for civil legal aid. He wrote, in part:

"Promoting legal aid and pro bono legal services has been a major emphasis of my time on the Court. I cherish how the Unified Judicial System has provided access to justice for so many Pennsylvanians as the Courts have worked to achieve the promise of equal justice for all. Yet the needs of our poorest citizens continue to challenge both the criminal and civil justice systems. A Constitutional mandate buttresses efforts for access to legal services in criminal matters, but an underfunded and overburdened civil legal aid system threatens delivery of civil services.

"...it is the volunteer efforts-­whether in direct representation of clients or further financial support -- that most greatly impact those in need, especially as we move out of the pandemic."

Volunteer attorneys are needed for a virtual Bucks County Custody Clinic on Wednesday, June 22 from 9 a.m.-12 p.m.

  • No family law experience needed.
  • Volunteers will be trained at CLE on Tuesday, June 14 at 12:30 p.m. (hybrid in-person/Zoom).
  • Fee: $35 BCBA Members, $60 Non-Members. Free CLE credit for training and for volunteer hours (CLE will be free if you volunteer at clinic or accept a LASP pro bono case).
  • Volunteers will NOT be expected to provide continued representation of clients.

Public benefits update
Moved during the pandemic? Update the County Assistance Office with your correct address and other contact information
The PA Dept. of Human Services asks people to update your address and other case information with the County Assistance Office, especially if you moved during the pandemic. All renewal documents will be mailed to the address on file with the County Assistance Office. To report changes to your case file, you can:
  • Submit the change online through your My COMPASS Account.
  • Call the Statewide Customer Service Center toll free number at 877-395-8930.

DHS also invites Medicaid enrollees to sign up for text alerts to ensure timely updates on benefits.
Delaware County - Crozer health closures
Update: Outpatient Behavioral Services at Community Campus in Chester to stay open through at least Aug. 31
CHESTER city - In April, Delaware County announced that Crozer Health planned to close all outpatient mental health and substance use disorder treatment services located at Community Campus in Chester by June 19. Services impacted are the Crisis Center at Crozer-Chester Medical Center and the Behavioral Health Outpatient and Ancillary Services at Community Campus.

In a statement issued May 25, Delaware County noted:
"Delaware County Council passed an emergency ordinance on April 20, 2022 requiring hospitals and long-term care facilities to provide notice to the County and develop closing plans when closing hospitals, significant units of hospitals, or long-term care facilities. On May 18, 2022, Delaware County filed a petition for a preliminary injunction against Prospect Crozer’s proposed closings in the Delaware County Court of Common Pleas.

"Prospect Crozer and the County have agreed to a stipulation with the court for Prospect Crozer to voluntarily maintain its behavioral health services operating through at least Aug. 31, 2022, pending continued discussions. As such, the hearing on the County’s petition for a preliminary injunction, previously scheduled for May 27, 2022, will be continued to Aug. 22, 2022 as determined by the Court."

ELKINS PARK - Get started on your second chance at a FREE Expungement Clinic. Hosts are Congresswoman Madeleine Dean and State Rep. Napoleon Nelson, with co-hosts Legal Aid of Southeastern PA and the Montgomery County Public Defenders.

The clinic is open to residents of Bucks, Chester, Delaware, Montgomery and Philadelphia counties. Interested residents must register to ensure that enough attorneys are staffing the event.

Clients of the Montgomery County Public Defenders can join LASP Wednesdays from 3-5 p.m. to get help with civil legal issues. LASP Independence Fellow Lily Austin gives details on the clinicshttp://bit.ly/3cu7p60.

The weekly clinic hours are intended to be a virtual version of the “walk-in” intake hours LASP offered before COVID-19. People can log onto Zoom and talk individually with Lily, one-on-one.

Mock trial at Montgomery Bar Association
NORRISTOWN - Michelle R. Dempsky, LASP Staff Attorney and Vice Chair of the Montgomery Bar Association's Diversity, Equity and Inclusion Committee, welcomes members of North Penn High School (NPHS) Rainbow Alliance to a mock trial to re-enact Doe v. Boyertown, a federal court case. Hon. Christopher J. Cirski, Montgomery County Magisterial District Judge (seated), served on the jury with eight students. Dr. David Hall (center) is a NPHS teacher and the Rainbow Alliance Adviser.
