Scenario 1:
A family with three children moved from Madison, Wisconsin to Rochelle, Illinois on June 20, 2021. The family moved to Rochelle, Illinois so the mother could work harvesting corn. The mother began working on June 22, 2021 harvesting corn. All three children are enrolled in the local elementary school. A recruiter finds and speaks to the family on June 27, 2021.
What is the residency date?
According page 4 of the National COE Instructions document, the residency date is the date the student arrived in the current school district.
Do the three children qualify for the Migrant Education Program?
Yes, the three children qualify for the migrant education program. The children meet all of the requirements laid out in Chapter II QA1 of the Migrant Education Program Non-Regulatory Guidance. The three children are still eligible for free public education because they are enrolled in elementary school. The three children made a qualifying move to Madison, Wisconsin to Rochelle, Illinois with a migratory agricultural worker.
If yes, what is the qualifying arrival date for all three children?
The qualifying arrival date for the three children is June 20, 2021. The qualifying arrival date is the date of the most recent qualifying move made by the students with, to join, or to precede a migratory agricultural worker. The most recent move the children made with the migratory agricultural worker was on June 20, 2021.
If yes, what is the residency date for all three children?
All three children arrived in the current school district on June 20, 2021 so the residency date the same as the qualifying arrival date and is June 20, 2021.

Scenario 2:
On April 17, 2021 a father moves to Oaktown, Indiana from San Luis Potosi, Mexico to begin a new job harvesting asparagus. From April until August, the man saves up the money he makes working on the farm so he can bring his wife and two daughters from Mexico to live with him. On September 2, 2021 the mother and two children move from San Luis Potosi, Mexico to Oaktown, Indiana. The children are 5 and 7 years old and the mother contacts a local recruiter because they need help enrolling the children in school. The recruiter speaks to the family on September 9, 2021.
Is there a migratory agricultural worker? If yes, when did they become a migratory agricultural worker?
Yes, there is a migratory agricultural worker. The family's father is a migratory agricultural worker because he made a qualifying move and soon after the move engaged in harvesting asparagus. The father became a migratory agricultural worker on April 17, 2021 and will remain a migratory agricultural worker until April 17, 2024.
Do the two daughter qualify for the Migrant Education Program? If yes, what is their qualifying arrival date?
Yes, the two daughters qualify for the Migrant Education Program. Their qualifying arrival date is September 2, 2021 because that is the date their most recent qualifying move was completed. The qualifying move is completed when both migratory agricultural worker and the students are together in the new location. Although they moved separately, the move is complete when the students moved to join the worker on September 2.
If the two daughters qualify for the Migrant Education, what is their residency date?
The two daughter's residency date is when they arrived in Oaktown, Indiana on September 2, 2021 because that is the date they arrived in their current school district.

Scenario 3
On January 15, 2021 Maria moved to Dayton, Ohio with her 13 year old son Oscar. Maria and Oscar moved from Houston, Texas to Dayton so Oscar could begin school and with the plan Maria's spouse Teri would join them when it was time for the work to begin in the area. Oscar has a learning disability and the family believed it was important for Oscar to get the entire semester at their new school so they could properly adjust to the change in environment. On May 2, 2021 Teri arrived in Dayton from Houston and got a seasonal job planting tomatoes in a greenhouse.
Is there a migratory agricultural worker? If yes, when did they become a migratory agricultural worker?
Yes, there is a migratory agricultural worker. Teri becomes a migratory agricultural worker when they moved to Dayton, Ohio on May 2, 2021 and engaged in planting tomatoes. Teri will be a migratory agricultural worker until May 2, 2024.
Does Oscar qualify for the Migrant Education Program? If yes, what is their qualifying arrival date?
Yes, Oscar qualifies for the Migrant Education Program. Oscar's qualifying arrival date is May 2, 2021 because that is the date their move to precede the migratory agricultural worker was completed. Since Oscar moved first their move was not complete until Teri, the migratory agricultural worker arrived.
If Oscar qualifies for the Migrant Education, what is their residency date?
Oscar's residency date is January 15, 2021 when they arrived in Dayton, Ohio. That is the date they arrived in their current school district.
