Texas Senate Bill 1 Signed Into Law
Makes It Easier To Detect And Punish Fraud
September 7, 2021 Tyler, Texas - The omnibus election integrity bill, Senate Bill 1 is signed into law by Governor Abbott.

True Texas Elections and our supporters from all over the state provided critical testimony to the Texas House and Senate as the bill progressed from its infancy in the 2021 Regular Session, to the 1st Special Session and through the 2nd Special Session.

So many Texas State Senators and House Representatives did God's work and the end results are that we now have a great set of new laws that will better prevent and detect fraud when our votes are counted. We especially thank Senator Hughes and his staff and Representative Murr and his staff for carrying this over the finish line.

We thank the dear Lord for the blessed victory. See below for what happens when God is present! Is there not a history of victory in Texas!
Details on New Laws Protecting the Vote Count
Relating to Paper Backup Records for Elections
  • Election judges at the polls must now print a Results Tape immediately upon closing of the polls on election day showing the votes each candidate received on the voting machine. This is one of the biggest wins - thank you Senator Hall! Tex. Elec. Code 61.002(c).

  • Election judges at the polls must now print a Zero Tape immediately before polls open showing all candidates have zero votes on the voting machines. Tex. Elec. Code 61.002(a).
Relating to Election Watchers
  • Watchers are now entitled to sit or stand near enough to see or hear election officers activities. Tex. Elec Code 33.056(a) and (f).

  • Watchers are now entitled to follow and watch the transfer of electronic media containing voted ballots into all areas the ballots are being processed from polls to regional sites, and central counting stations. Tex. Elec. Code 33.0605(b).

  • Watchers shall not have their view obstructed by election officers. Tex. Elec. Code 33.061(a).

  • Those entities that appoint watchers have the explicit statutory standing to civilly sue election officials for obstructing watchers. Tex. Elec. Code 33.0963.

  • Election officials that prevent a watcher from entering service are subject to a Class A misdemeanor. Thank you Senator Hughes and Representative Murr! Tex. Elec. Code 33.051(g).

  • Development of an online watcher training program to educate election watchers, county officers, and election judges on the statutory duties and rights of watchers.
Relating to Transparency of Vote Counting
  • Central counting stations in counties of more than 100,000 population must implement a video surveillance system that tracks all areas containing voted ballots. The video system must be live streamed! Tex. Elec. Code 127.132(b,c, and d).

  • Central counting station computers tabulating votes must be equipped with software that tracks all input activity on the device. Tex. Elec. Code 129.009(a).

  • By 2026, ballot scanners at central counting stations must now only use write-once media. Tex. Elec Code 127.1301.

  • Requires auditing of voting machines and central counting station tabulation computers before and after an election. Tex. Elec. Code 43.007(c).

  • Ballots cast are early voting locations and by mail must be tabulated separately on the election returns. Tex. Elec. Code 87.103(a).

  • Central counting station presiding judges must reconcile votes cast and ballots tabulated. Tex. Elec. Code 127.131(f).
Relating to Civil & Criminal Remedies for Vote Counting Fraud
  • A candidate can now civilly sue their opponent, an agent of their opponent, or someone acting on the behalf of their opponent related to election fraud. Tex. Elec. Code 247.001.

  • Easier to have Sec. of State report fraudulent activity to the Attorney General. Tex. Elec. Code Tex. Elec. Code 31.006(a).
Relating to Prohibition of Waivers
  • The election code, 127.201(f), that permitted the Tex. Sec. of State to waive partial manual recounts was repealed.

  • A public official or election official shall not create, alter, modify,waive, or suspend any election standard, practice, or procedure mandated by law or rule. Tex. Elec. Code 276.019.

  • Election officials and public officials must interpret the code uniformly. Tex. Elec. Code 1.003(a-1)
Relating to Random Election Audits
(Honorable Mention for Representative Bryan Slaton)
Representative Bryan Slaton proposed an amendment on the House Floor for randomized county election audits of two large and two small counties per year. Tex. Elec. Code 127.351. Thank you Representative Slaton - this passed by 2 votes! Look below for who voted for (green), against (red), and were absent (neither red or green).
Overall, this bill is a great win for Texans - our laws are significantly improved to better prevent and detect vote counting fraud. Thank you to all the Senators and House Representatives for holding to their sworn covenant with God and Texans to uphold the Constitution.
