CMS Pulls MFAR, Guidance on POC Testing Machines,
Provider Relief Fund Deadline Extended, Help Stop Medicare Cuts
CMS Pulls the Medicaid Fiscal Accountability Rule (MFAR)

There was big news out of Washington late yesterday. Centers for Medicare and Medicaid Administrator (CMS) Administrator Seema Verma announced via Twitter that CMS was pulling the Medicaid Fiscal Accountability Rule (MFAR). Her tweet is below and can also be viewed online here.
MFAR would have had a devastating impact certain states such as Indiana, Texas, and Utah and would have been challenging to provider assessments in at least 25 states.

We greatly appreciate Administrator Verma listening to our concerns and pulling the rule. This result further verifies the value of all of us pulling together and letting the powers in DC know of our concerns. We want to thank the AHCA government affairs team, led by Clif Porter, for handling this challenging issue so well and playing a big part in leading to this conclusion. We appreciate everyone that was involved in this effort!
Guidance for Nursing Homes on Point of Care Testing Devices
Yesterday evening, the Office of Health Care Quality (OHCQ) released this guidance related to POC testing devices. OHCQ has prepared the document to assist nursing homes with obtaining or changing their lab permits and for setting up a safe testing area. Please review this guidance in detail and be on the lookout for additional guidance on the use of POC testing machines and other important items.
Deadline Extended for Phase 2 General Distribution

The Health and Human Services (HHS) has has extended the deadline to apply for the Phase 2 General Distribution round of Provider Relief Funds to September 21 for eligible AL communities.

If you are a private pay or Medicaid-certified assisted living/memory care community, ensure that you apply for the HHS Phase 2 General Distribution round of Provider Relief Funds. HHS announced recently that private pay AL operators are eligible to apply. Non-SNF Medicaid providers are also eligible. ​Note that the deadline for the application has been extended until Monday, September 21.

Like other providers applying for Phase 2 funding, eligible assisted living communities will receive 2 percent of their annual revenue from patient care.

We Need Your Support: Stop the Medicare Cuts to Providers!

On August 3, 2020, the Centers for Medicare & Medicaid Services (CMS) issued its 2021 Medicare Physician Fee Schedule (PFS) proposed rule. In the 2020 final PFS rule, and again in the 2021 proposed rule, CMS included substantial reductions in payment to more than three dozen health care provider specialties, effective January 1, 2021. The cuts were proposed in order to maintain budget neutrality while increasing payment for office-based evaluation and management visit codes, also called E/M codes, that primary care and some specialty health professionals use to bill for their services.

In particular, physician SNF visits; physical and occupational therapy, and speech-language pathology services; as well as portable x-ray services under Medicare Part B are slated for cuts between 6 and 11 percent. These cuts on top of the current economic crisis are unsustainable and will result in reduced access to care as fewer of these professionals will seek to care for this vulnerable population.  

Please contact your Members of Congress to ask them to reach out to both Secretary Alex Azar and CMS Administrator Seema Verma and ask them to postpone implementation of these harmful cuts within their authority. We also ask that Congress waive the budget neutrality requirements stipulated in Section 1848(c)(2) of the Social Security Act before the final E/M code proposal is implemented on January 1, 2021.

This much-needed action by Congress, for inclusion in any forthcoming legislative package, will provide a critical reprieve for a broad scope of health care professionals facing substantial payment reductions in the coming months.
