The Devil You Thought You Knew:
Olchowski and Rule 1.15
 
Please join the REBA Ethics Section for a webinar at 12 noon on Monday, August 9th on proposed amendments to the SJC’s Rules of Professional Conduct, which will impact every real estate and transactional lawyer in the Commonwealth. Our panelists include Hannah L. Kilson, a Partner at Nolan Sheehan Patten LLP and Chair of the Massachusetts IOLTA Committee, and Henry J. Dane, a Partner at Dane, Brady & Haydon, LLP and Co-chair of REBA’s Ethics Section.
 
There were nearly $30,000 of unidentified funds in Gregory Olchowski’s IOLTA account when he was disbarred after pleading guilty to four counts of Federal tax evasion. After a fruitless investigation, both the IOLTA Committee and the State Treasurer both laid claim to the money. The dispute was settled by the SJC last October, and in so doing, immortalized Mr. Olchowski, (485 Mass. 807).
 
‘Who gets the unclaimed money?’ is just one of the things that will be changed by the proposed amendments to the Rules of Professional Conduct; and it will no longer be possible to balance the books by sending a check to the State Treasurer. Comments on the proposed amendments to Rule 1.15 and Rule 1.15A(e) are due by October 1st. Our panelists will discuss and comment on these changes, including additional record-keeping and record-preservation requirements. Following final adoption of these proposed rules, the BBO will promulgate procedural regulations on implementation.
