Unauthorized Practice of Surveying in the Town of Birch Hills

In the July Quarterly report, PSC talked about the Unauthorized Practice of Surveying in the Town of Birch Hills.

The Town of Birch Hills, Saskatchewan, on their website was offering a lot corner location service for its residents at a low cost. The Saskatchewan Land Surveyors’ Association approached the Town regarding the unauthorized practice of surveying, but no retraction of survey monument location services was made.

Professional Surveyors Canada has engaged a Saskatchewan based lawyer to research the liabilities and legalities associated with the unauthorized practice of land surveying by municipalities, and to write an article on the matter to be published in a manner targeting municipalities across Canada. These practices result in significant liability for municipalities and their residents with negligible benefits, and PSC’s goal is to effectively communicate this message to municipal leaders in a positive manner.

After a long period, in July 2020, Birch Hills ceased locating survey monuments for their citizens.

PSC continues to develop media for the purpose of preventing the unauthorized practice of professional surveying across Canada.

Dans le rapport trimestriel de juillet, GPC a signalé un exercice non autorisé de l’arpentage dans la municipalité de Birch Hills.

La municipalité de Birch Hills, en Saskatchewan, offrait sur son site Web un service de localisation des limites de terrain à ses résidents à bas prix. La Saskatchewan Land Surveyors’ Association a communiqué avec la Municipalité au sujet de cet exercice non autorisé de l’arpentage, mais aucun retrait des services de localisation de bornes d’arpentage n’a eu lieu.

Géomètres professionnels du Canada a embauché un avocat de la Saskatchewan pour faire des recherches sur les responsabilités et les aspects légaux associés à l’exercice non autorisé de l’arpentage des terres par les municipalités, et pour rédiger un article sur le sujet, qui sera publié d’une manière ciblant toutes les municipalités du Canada. Un exercice non autorisé de l’arpentage engage la responsabilité des municipalités et de leurs résidents tout en ne leur apportant que des avantages négligeables. L’objectif de GPC est de communiquer ce message de façon efficace et positive aux dirigeants municipaux.

Après une longue période, en juillet 2020, Birch Hills a cessé d’offrir des services de localisation des bornes d'arpentage à ses citoyens.

GPC continue d’élaborer des messages médiatiques pour prévenir l’exercice non autorisé de l’arpentage au Canada.

The historic documentation is important to Becker County because it wants to upgrade a stretch of West Lake Drive, but can’t do so until it obtains clear right.

Becker County has discovered historical road documents that commissioners think will give a big lift to the county’s chance of prevailing in an upcoming court case over right-of-way on West Lake Drive.
“Through a stroke of luck, Meadowland Surveying came up with an 1872 ‘road area’ document from two years after the area was first surveyed,” County Surveyor Roy Smith told Becker County commissioners at their board meeting Tuesday. Read more
NSPS Seeks House Committee Oversight and Repeal of AAM-212

In response to an inquiry of the business community in identifying job killing regulations to roll back, NSPS urged the ranking member of the House Committee on Oversight and Reform, Rep. James Comer (R-KY), to conduct oversight and an investigation into the expansion and applicability of the Davis-Bacon Act to members of surveying crews working on federal financed construction projects. This expansion was initiated by All Agency Memorandum (AAM-212), issued by the Department of Labor's (DOL) Wage and Hour Division during the Obama Administration on March 22, 2013. NSPS Executive Director Curtis Sumner wrote, “We believe the classification of members of survey crews as “laborers and mechanics” is detrimental to our profession and an inappropriate demotion of valued and skilled employees … Read more in the NSPS newsletter
FCC Broadband Data Map Rules Go Into Effect Sept. 17

The FCC's rules for establishing a new broadband data collection regime go into effect Sept. 17.
The comment dates have also been set for proposals on how the FCC can provide consumers, governmental entities and others the ability to verify and/or challenge the new maps.

The surveyor and the cadastre: Why can’t we be friends?

Our ongoing battle with COVID-19 has shown we can adapt to radical changes. A big, but worthwhile, change would be to convert our existing land databases to a cadastre system.
Any place that one may travel around the globe, they will find boundary lines that define properties and regions. For some countries, these parcels may be primarily owned by the government while in more developed nations, a large percent of the land is owned by private citizens.

Boundaries, physical restrictions announced for new Newfoundland and Labrador offshore sector

The Canada-Newfoundland and Labrador Offshore Petroleum Board (C-NLOPB) has issued the final design for a new Eastern Newfoundland Region Sector, which was announced as a general location on June 11, for future oil exploration in the province’s offshore.
A news release Wednesday notes the final sector design is fully contained within the general location that was referenced in June. Read more

Plants fly and hair pulled in garden dispute

An argument over garden boundaries in Dunedin yesterday ended in plants and garden equipment being thrown down a hill and a warning for assault.
The incident started when an argument broke out between two neighbours in Coolock Crescent, in Waverley, over property boundaries. Read more
