NYC requiring proof of vaccination for indoor dining
Enforcement starting September 13, 2021
The NYC Mayor announced that the City will require proof of vaccination for indoor dining, gyms and performance venues starting August 16, with enforcement to start on September 13, 2021. NYC launched the free app "NYC COVID SAFE" that captures an image of the vaccination card. NYS has been operating the "NYS Excelsior Pass Wallet" app, that checks vaccination status against NY State databases. Both apps are free and will be accepted as proof of vaccination. Hurricane Ida and Small Business Recovery Tips
The NYC Department of Small Business Services recommends determining whether you have access to your space, assess any damage and consider the following:
  • Will you be able to conduct business in the near-term?
  • Are your employees impacted and/or can they can travel to the work site?
  • What insurance do you have, and do you have access to the records needed to file a claim? 
Post-loss insurance tips: 
  • Immediately contact your insurance company or broker/agent.
  • Carefully read your insurance policy to understand what losses are covered.
  • Take photographs or a video of the damaged areas and assets to help with your claim.
  • Don’t remove any damaged property until the insurance adjuster has assessed the damage and made an official report.
  • Make only those repairs necessary to prevent any further damage; if you make permanent repairs unauthorized by the insurance company, they may not be covered.
  • Keep all receipts for repairs and temporary business expenses.
  • To help establish the value of your claim, prepare a detailed inventory of all damaged or destroyed property (item, quantity, date of purchase, cost at purchase, age, and estimated replacement cost), along with your pre-loss photographs.
  • Accompany the adjuster to point out damage during the inspection.
  • If the settlement offered by the insurance company seems unfair, contact the New York State Insurance Department by visiting www.dfs.ny.gov.
  • If the insurance company denies any part of your claim, get the denial in writing, and keep copies.
  • Always contact your insurance company and claims adjuster any time you find additional damage not previously reported.

Advocating for improved infrastructure on Morris Park Avenue and in the Bronx
Morris Park avenue is where power players eat in the Bronx! Thanks to Senator Chuck Schumer and Bronx Borough President Ruben Diaz Jr. for supporting our small businesses!

The City and State of New York must fund infrastructure in the outer boroughs!
Over the ground power and utilities wiring cluttering the esthetics of the Morris Park Avenue commercial corridor, and causing
vulnerability to tree falls, weather conditions and creating an ongoing need for maintenance and repairs.
Relief on certain fines for properties and small business violations passed by the NYC Council
Property and business owners should be aware of the following bills passed over the summer, that provide relief for certain violations.
  • 1) Int 2234-2021  enacted 7/18/21
This bill, sponsored by Bronx Democrat Mark Gjonaj, creates a temporary 90 day amnesty program, which would allow for businesses to receive a 75% discount on any unpaid fines issued after Governor Andrew Cuomo called for a state of emergency on March 7, 2020. In addition, any unpaid fines dating back eight years would be eligible for a 25% discount, with all interest and late fees waived entirely. This bill would require the Commissioner of Finance to establish a temporary program to resolve outstanding judgments imposed by the Environmental Control Board. Subject to certain conditions, default penalties and associated accrued interest would be waived, respondents would be able to resolve judgments docketed prior to March 7, 2020 by payment of 75% of the imposed penalties without payment of accrued interest, and respondents would be able to resolve judgments docketed on or after March 7, 2020 by payment of 25% of the imposed penalties without payment of accrued interest. The program would last for 90 days in fiscal year 2022 and the Commissioner would be able to extend the program for an additional 90 days. Judgments entered in the 90 days leading up to the start of the program would be ineligible for resolution. Respondents who made certain partial penalty payments prior to the start of the program would be eligible to resolve the associated judgments.

  • 2) Int 2233-2021 enacted 7/18/21
The second bill, sponsored by Bronx Democrat Vanessa Gibson, aims at more permanent changes to the City’s system of collecting fines for code violations. The bill would change 185 code violations to lower fine amounts, while also creating a “cure period” in which businesses would have the opportunity to fix whatever issue they have before facing any fines. For example, businesses currently face fines for not properly labeling their garbage bins. Under the new legislation, they would be allowed to fix the mistake without facing penalties, while still facing fees for repeat offenses.

Thank you to the Bronx NYC Parks & Recreation Department for bringing arts, culture and fun series to Loreto Park this past July. It has been a pleasure working together this past month. The Morris Park community celebrated the last event of the series this past Wednesday with some arts & crafts & pizza! Special thanks to NYPD 49 Precinct Youth Coordination Officer Michelle Fernandez and her Explorers team for the special appearances! And last but not least, thanks Emilio's of Morris Park for the yummy pizza 🍕
