We hope that you and your family have been enjoying the summer. Since the start of the pandemic, RSP has prioritized the health and well-being of its clients, strategic partners, and employees, while continuing to service our clients’ legal needs.
As COVID-19 vaccines have now become widely available, we see reasons for optimism in our economy. The population of vaccinated people continues to grow and the number of new cases is showing a significant decline from last year’s winter peaks.
As our lives return to some semblance of normalcy, I want to reiterate RSP’s strong commitment to our clients and the legal community. We have always been and will continue to be here to help address any of our clients’ needs for legal services. We appreciate your relationship with RSP and value your loyalty.
We are excited that our attorneys and staff are beginning to work in the office on a more regular basis and we welcome you to visit. We will continue to follow the latest CDC guidelines on safety, enhanced cleaning, and social distancing. No proof of vaccination is needed when visiting our offices. However, we require any unvaccinated visitors to wear a mask while in our offices.

Returning to the Office: Is the COVID-19 Vaccine Required?

The Equal Employment Opportunity Commission (EEOC) has issued a guideline on one of the biggest questions Americans are asking as they return to work: Can my employer require me to get the COVID-19 vaccine?
In short, yes. The EEOC says that the vaccine may be a requirement of returning to work, but the employer must provide a reasonable accommodation for employees with disabilities or religious objections, unless the accommodation poses an “undue hardship” on the operation of the employer’s business.

Hunting for Damages in
Construction Litigation

A disturbing trend in construction litigation is the filing of lawsuits without knowing what the damages are and without knowing whether any damages are recoverable. Often this leads to even more protracted litigation and frustration from both sides. The plaintiff is frustrated because it cannot understand why its demands are not being met. The defendant is frustrated because it cannot understand why the demands made by plaintiffs are so unreasonable.

Consumer Privacy Legislation?

A big push is underway in 27 states to enact consumer data protection laws. Ten states have tabled these legislative attempts. Virginia and California enacted comprehensive consumer privacy laws. Colorado also passed such a law which is on the governor’s desk awaiting signature.
State consumer data protection laws vary greatly, but all share elements of European Union law which went into effect in 2018 and California law which became effective in 2020.

Alcohol for drinking is widely available across America. However, there are a few states, counties, cities and precincts where the sale of alcohol is either totally illegal (no alcohol of any kind intended for human consumption may be sold) or partly illegal (usually beer and wine may be sold, but not hard liquor). Can this harsh regulation of this one industry be legal? Yes, it is.

She discussed the different approaches to working with secured and unsecured creditors from a commercial litigation perspective. Diana also outlined legal hurdles for each type of capital provider and how the legal landscape may change for them in the future.

Andrés J. Gallegos was a speaker for The Whole Person, an organization providing services and resources to people with disabilities and their families, discussing the topic “Accessible Healthcare” on April 27th. He also was a panel member for the Seventh Circuit Bar Association on "Disability in the Time of COVID: How 'Remote Everything’ is Changing the Rules of the Game for Courts, Legal Employers, and Disabled Attorneys."
On April 14th, Andrés was a presenter for the University of Illinois Chicago's Health Equity and Ethics Series discussing "Uncovering Disability Bias and Discrimination in Healthcare." Additionally, he authored an op-ed for the Health Affairs Journal on the topic “Misperceptions Of People With Disabilities Lead To Low-Quality Care: How Policy Makers Can Counter The Harm And Injustice” published April 1st.

Sender have accepted the "Excellence in Accessibility Advocacy" Award from the Illinois Association of the Deaf (IAD). The Award as shown below is presented to an organization or agency in recognition of excellence in advocacy for accessibility. IAD promotes the advancement of the social, educational, and economic well-being of the deaf and hard of hearing citizens of Illinois.

Rita W. Garry participated as a speaker for Financial Poise on the topic “Roadmap to Selling a Business or Taking on Outside Investors” held June 8th. Financial Poise provides business, financial, and legal education to individuals investors, entrepreneurs, business owners, and executives, Rita also authored “Where Is the Consumer In Consumer Privacy Legislation?” for The Law Journal Newsletter published in June.

Andrew W. Lapin authored “Can Restaurants Come Back Stronger than Ever?” published June 9th by QSR Magazine, a publication targeting quick service and full service restaurants. He also was interviewed for the Business Insider, a digital news source for business leaders, in connection with the articles "Restaurants pushing digital orders in the labor shortage could mean diners asking for more food because they don't feel judged by servers" and "A restaurant owner says raising wages to $15 would solve her labor shortage — but she'd have to hike menu prices. Instead, she's turning to automated drive-thrus." The articles were published July 5th.

Laurie A. Martin Montplaisir was selected among leading industry asset-based lending women as a honoree for the ABF Journal’s Inaugural Women 2021 Issue on Asset-Based Lending. The publication highlighted women in the industry who are the legends, the trailblazers and the next generation leaders. She also was a panel member for the “Roundtable for Women in Commercial Finance” at the International Factoring Conference: Legal Forum held May 14th.

Corneilus F. Riordan was a speaker for NCS on the topic "The Ins and Outs of Construction" on June 17th. NCS is known as an industry leader throughout the U.S. and Canada in collections, mechanic’s lien laws and UCC filings.

Andrew M. Sach was interviewed for The ABL Advisor, a publication targeting asset-based lending professionals. The article, "A Profile in Longevity", published April 16th, discussed Andy Sachs' long-standing career with RSP.

Jennifer M. Sender
Jennifer M. Sender was appointed as a Commissioner to the Illinois Deaf and Hard of Hearing Commission (IDHHC). The appointment is effective immediately through November 2024. IDHHC is an executive state agency that promotes education and awareness of the legal requirements for effective communication on behalf of people with hearing loss in Illinois.

Weisberg was a co-presenter for the Hispanic American Construction Industry Association and the Innovation DuPage, a non-profit venture entity for start-ups and small businesses, discussing legal issues for the Construction Industry Owner-to-CEO Business Accelerator Program held April 21st and 22nd. He also has authored "Negotiating Construction Contracts" for the book, 2021 Edition-Construction Law: Transactional Consideration published by IICLE in June.
