Annexation Petition Update
Town Council has heard and respects the community's concerns regarding the Andell West Annexation Petition and Planned Development application from Haulover Creek Development Company, LLC, (an affiliate of the Goodwin Family Holdings (owner of the Kiawah Island Golf Resort) and Riverstone Properties).
 
While the annexation process and planned development review are separate processes, Town Council has worked with the applicant on behalf of the community to make a way forward that best serves our shared community.
 
As a result, the applicant has notified the Town that they will be amending their scope of work and submitting a new annexation petition for the commercial portion of the property only with no residential component. The applicant must subdivide the property with Charleston County before submitting a new annexation petition to Town Council. There is no timeline for submission at this time.

The Town is committed to being transparent about the process and sharing information as soon as possible, as was done upon receiving the previous application. As a reminder, an annexation petition can only become public once an applicant submits the official petition. When the new petition is submitted, the Town will notify the public through our email distribution list and website
 
When submitted, Town Council will evaluate whether the annexation would be in the best interest of the residents and the community based on the specifics of the petition and community input.
  
The Town has no further information on the developer's intent for the residential component. The parcel is presently in unincorporated Charleston County and zoned R-4, Single Family Residential, allowing four dwelling units per acre.

Based on this information, the previously announced 2nd Planning Commission workshop has been canceled. Public comments received through the comment portal for the Planning Commission will be available on Monday, September 20, by noon. Annexation Process Information
Annexation is a legal procedure where a property owner may petition the Town to be incorporated into their municipal boundaries when the property is contiguous to the existing town limits.
 
The annexation process consists of a submission of an annexation petition for a specific piece of property followed by the adoption via ordinance by Town Council for the property under consideration. The process consists of two public meetings where the application is discussed and community input is received. Town Council has final approval over annexation.
