In recognition of the important role people with disabilities play in a diverse and inclusive American workforce, the theme for National Disability Employment Awareness Month (NDEAM) 2022 is “Disability: Part of the Equity Equation.” Observed annually in October, NDEAM celebrates the contributions of America’s workers with disabilities past and present and showcases supportive, inclusive employment policies and practices.

The U.S. Department of Labor’s Office of Federal Contract Compliance Programs joins
celebrating the 77th anniversary of 

NDEAM celebrates the contributions of America’s workers with disabilities, past and present, and showcases supportive, inclusive employment policies and practices. This year’s theme is “Disability: Part of the Equity Equation.”
In his Presidential Proclamation for NDEAM, President Biden stated that his Administration’s Labor Department is protecting the rights of workers with disabilities in the private sector, cracking down on employers who discriminate, and ending the unfair use of sub-minimum wages. As the President declared, “This month, let us acknowledge workers with disabilities who make our communities, our economy, and our Nation stronger. Let us continue the legacy of generations of disability rights activists who have fought for equal employment opportunities, integrated workplaces, and equal pay for equal work. Let us deliver the promise of America to all Americans.” 
OFCCP enforces Section 503 of the Rehabilitation Act of 1973, as amended, and works to ensure that workers with disabilities have equal opportunity in the workplace. In September, OFCCP filed a lawsuit against a federal contractor after an investigation found that the employer allegedly fired an employee with a disability for having a disability and requesting a reasonable accommodation. As part of its efforts to advance equal opportunity for people with disabilities, OFCCP provides federal contractors with technical assistance and guidance on their anti-discrimination and affirmative action obligations under the law. The agency also provides contractors with assistance in analyzing their utilization of individuals with disabilities against the aspirational goal established by OFCCP that at least seven percent of the workforce comprises persons with disabilities.
The initiatives to promote disability inclusion and reasonable accommodations at work include:
  • Resources for Recruitment and Hiring of Qualified Individuals with Disabilities – Federal contractors can visit OFCCP’s webpage for resources for Recruitment and Hiring of Qualified Individuals with Disabilities. These resources can help federal contractors expand their access to qualified individuals with disabilities.
  • Section 503 Best Practices and FAQs for Federal Contractors – As a part of OFCCP’s ongoing efforts to support federal contractor compliance with Section 503 of the Rehabilitation Act regulations, the agency provides best practices and frequently asked questions to assist contractors in meeting their equal employment and affirmative action obligations.
  • Reasonable Accommodation Pocket Card – The Reasonable Accommodation Pocket Card helps applicants, employees, and other interested parties understand the process for requesting a reasonable accommodation.

Duckworth and Sarbanes Introduce Bicameral Legislation To Help Make Websites and Software Applications Accessible to People with Disabilities

[WASHINGTON, DC] – U.S. Senator Tammy Duckworth (D-IL) and U.S. Representative John Sarbanes (D-MD-03) introduced legislation to help break down the significant barriers that Americans with disabilities continue to face when accessing website and software applications, which all Americans rely on for employment, commerce, education, public services and all other aspects of society. The Websites and Software Applications Accessibility Act would build on the promise of the Americans with Disabilities Act (ADA)—passed over 32 years ago—by requiring that entities currently covered by the ADA, as well as commercial providers, maintain websites and software applications that are accessible for Americans with disabilities. This legislation would also establish a clear accessibility standard as well as establish a technical assistance center and advisory committee to provide advice and guidance on how to develop and maintain accessible websites and applications.

Additionally, this legislation would authorize a study on the effects that emerging technologies have on the ability of individuals with disabilities to participate in society.

“Throughout the COVID-19 pandemic, and well before, so many Americans relied on the internet to work from home, order home goods and connect with loved ones—and yet, too many websites and apps remain nearly impossible to use by Americans with disabilities, barring them from these experiences and opportunities,” said Senator Duckworth. “I’m proud to introduce this legislation with Congressman Sarbanes to finally help make the web and other technology more accessible for all users, including those in the disability community.”

“Digital innovation is only as powerful as it is inclusive. As new and emerging technologies have been incorporated into our daily lives, digital inaccessibility has prevented Americans with disabilities from reaching a broad range of health, education, employment and other critical resources. To address this civil rights issue and remedy this longstanding inequity, we need uniform, consistent standards that lay out what true digital accessibility is and provide adequate mechanisms to enforce it,” said Congressman Sarbanes. “The Websites and Software Applications Accessibility Act will require federal agencies to provide clear regulations for reducing barriers to web accessibility and help businesses and state and local governments work toward compliance. Senator Duckworth and I are pleased to introduce this legislation with the input of disability advocates to take an important step to achieving equity and inclusion for all Americans.”

“Although we have had some success in vindicating the right of blind Americans to live and work in our increasingly digital world, individual complaints and agreements simply cannot keep pace with the expansion and evolution of technology, and entities who want to effectively serve customers with disabilities are asking for guidance,” said Mark Riccobono, President of the National Federation of the Blind. “We commend Senator Duckworth and Representative Sarbanes for introducing this legislation, and we urge their colleagues to act swiftly on this common-sense proposal that will finally close the gap caused by inaccessible technologies and clarify and enforce what our nation’s disability laws and policies require.”

“This bill is as significant as the introduction of the ADA and shows the cooperation and support from the disability community,” said Tony Coelho, former Democratic Congressman from California and author of the ADA. “As President Bush said on the signing of the ADA—‘the walls of exclusion need to be taken down’—this is another step in that direction.”

“This bill builds on the strength and success of the ADA and significantly advances access to the digital world by covering, for the first time, the commercial providers who actually design websites and mobile apps,” said John L. Wodatch, disability rights attorney and principle architect of the ADA’s regulations.

While the U.S. Department of Justice (DOJ) has long held that the ADA covers websites and other technologies that are critical to accessing a business or agency and its services, the DOJ has not yet issued accessibility regulations covering websites and applications to accommodate Americans with disabilities. Additionally, despite existing DOJ guidance stating that websites should be in compliance with the ADA, it does not yet address applications and software in “smart” devices, such as cars, refrigerators, tractors, phones, thermostats and so on.

Furthermore, courts have not consistently interpreted whether and how the ADA covers websites. While this legislation does not amend the ADA, it affirms that the ADA requires websites and applications used by certain businesses be accessible and useable by Americans with disabilities and that this requirement applies regardless of whether the business has a physical location or merely exists online.

The Websites and Software Applications Accessibility Act also directs the DOJ and Equal Employment Opportunity Commission (EEOC) to issue regulations that help ensure Americans with disabilities have equal access to websites and applications as nondisabled people.

Along with Duckworth, this legislation is co-sponsored by U.S. Senators Bob Casey (D-PA), Brian Schatz (D-HI) and Ed Markey (D-MA).

Six Things for Employers to Consider When Hiring Individuals With Disabilities

Amid the ongoing workforce shortage, businesses are finding it more challenging than ever to hire talented workers. One source of talent employers should consider is people with disabilities. By recruiting, hiring, and retaining these individuals, businesses can give themselves a competitive edge and demonstrate their commitment to inclusion. The key is to focus on what a person can do rather than their limitations.

People with disabilities comprise the largest minority group across the globe. As of 2018, only 29% of Americans of working age with disabilities participated in the workforce, meaning there is a potential untapped talent pool. Not only that, studies show that companies leading in hiring persons with disabilities were, on average, twice as likely to have higher total shareholder returns than those of their peer group. Other research shows that GDP could increase by $25 billion if just 1% more persons with disabilities joined the U.S. labor force. And employees with disabilities are often more loyal meaning less turnover.

October marks Disability Employment Awareness Month (DEAM). As we celebrate disability talent and innovation, we must also build a future that includes 1.3 billion people with disabilities worldwide in the workplace.

From data gathered through this year’s Disability Equality Index, we know that disability inclusion is becoming a staple of corporate diversification agendas and that disability-inclusive practices have become the industry standard.

The future of work must be accessible and inclusive. It must empower people with disabilities to participate meaningfully and fully. Each of us has a role to play in building an inclusive global economy.

October is National Disability Employment Awareness Month (NDEAM), which celebrates the contributions of America’s workers with disabilities and showcases supportive, inclusive employment policies and practices. The U.S. Department of Labor themed this year’s NDEAM observance as “Disability: Part of the Equity Equation” to recognize the important role people with disabilities play in a diverse and inclusive workforce. Our organization, formerly the DC Metro Business Leadership Network, is the largest regional member network of a variety of industry employers advocating for inclusion of individuals with disabilities in today's workforce, marketplace and supply chain. A non-profit business-led network established in 2006, our purpose is to bring the business community together in a dialog through education, training and resources with a focus on removing attitudinal and organizational barriers by exchanging best practices to ensure that the inclusion of individuals with disabilities as smart business.

Our Staff

The Hon. Katherine McCary, President, C5 Consulting, LLC serves as CEO and Executive Director. Katherine served as founding chair of the USBLN (now Disability:IN) for nine years, the founding chair of the VA BLN (Now Virginia Ability) for 13 years and has launched more than 11 chapters. She received the USBLN Lifetime Achievement Award in 2009.
C5 is a global disability inclusion strategy consultancy comprised exclusively of private sector disability leaders, experienced disability from a variety of areas; as individuals, as caregivers, and as parents of individuals with disabilities. With more than 50 years combined expertise and a deep knowledge of culture change developed through customized business strategies.
