Missouri Supreme Court Releases Much-Needed Revisions to Missouri’s Civil Discovery Rules

On March 2, 2021, the Missouri Supreme Court released an order (Order) amending the Missouri Rules of Civil Procedure (Missouri Rules) to enact new discovery provisions. This is the culmination of the attempts over the last two years to revise the civil discovery rules in Missouri, and hopefully one that will bring clarity to practitioners across the State.

While the Federal Rules of Civil Procedure (FRCP) have been updated several times over the last 15 years, the Missouri Rules have remained largely unchanged. One particularly glaring absence has been any mention of the discovery of electronically stored information (ESI), or e-discovery, in the Missouri Rules. The FRCP were amended in 2006 to include provisions on e-discovery, but the Missouri Rules remained silent on the issue.

Much of the work to plan and implement the St. Louis Chapter’s extensive programming and

events is done through our committees. We have a variety of committees and serving on a

committee is not a huge time commitment and is a great way to get to know more ACC

members.

The committee work is done through phone calls and can be done on your schedule so it will fit in with your busy workday. Additionally, Board Members are generally recruited from active committee members. We hope that you will get involved by serving on a committee this year.

Join Our Litigation Practice Area Network

The ACC-St. Louis Chapter is pleased to announce the formation of a Litigation Practice Area Network. This PAN is sponsored by the law firm Swanson, Martin & Bell, LLP and will provide networking and continuing education opportunities throughout the year. Swanson, Martin & Bell, LLP is a nationally recognized trial firm that, since the firm was founded in 1992, has tried over one thousand cases to verdict in a wide variety of areas including commercial disputes, intellectual property, professional negligence, healthcare, product liability and toxic tort.

This PAN’s first event will be a virtual CLE presentation on April 21 entitled, “Post-Pandemic Litigation: What to Expect.” The expert panel of litigators from Swanson, Martin & Bell will address:

Status of reopening of local courts and what reopening will look like.
Types of litigation arising out of the pandemic.
What value-added litigation practices has COVID-19 ushered in that clients should demand to stay?

This CLE is approved for 1.2 general hours of Missouri CLE and Illinois CLE approval is pending. Register here for this program.

Practice Area Networks are a unique feature of both the National organization and the ACC-St. Louis Chapter. These networks provide convenient ways to interact and are open to all members.
