Defense Verdict in
Trip and Fall Case



We are pleased to announce that TKCK’S Tort Group — led by Partners Matthew Slater and Daniel Buckley — secured a complete defense verdict on a high exposure premises liability case for a large property developer in New England. 

The Plaintiff alleged that she tripped and fell on uneven spider cracks in a commercial parking lot of a retail plaza and sustained a serious hip fracture. She was taken by ambulance to the hospital and underwent almost immediate surgical intervention and endured vigorous rehabilitation therapy. She called multiple experienced construction personnel to testify on her behalf about the use of crack filler in parking lots and alternative methods of correcting spider cracks and unevenness. The trip and fall was captured on video surveillance footage and the Plaintiff’s nasty face first fall was shown to the jury multiple times during the course of the trial. 

After a three day trial in Superior Court, and nearly four hours of deliberations, the jury returned a complete defense verdict for our client.
