Illinois General Assembly

T he General Assembly  is adjourned until the fall veto session. 

HR 866 - Thapedi -  Declares that it is in the best interest of the people of Illinois for the Governor of the State of Illinois to immediately act to shape a narrowly tailored approach to drastically improve the housing stock, communities, and conditions of and for people of African descent residing in the State of Illinois. Urges the Governor of the State of Illinois and the Illinois General Assembly to invoke the principles of the Equitable Economic Land Use Plan of 2020 with all deliberate speed. Declares that funding should be directed toward low-income communities in Illinois for infrastructure, housing, and other economic development. Declares that the Illinois Code of Civil Procedure and the Mortgage Act should be reformed and to further fund existing housing programs that will assist people of African descent in the facilitation of the Equitable Economic Land Use Plan of 2020. Declares that the Menard Correctional Center should revert back to its original name, Southern Illinois Penitentiary.

Secretary of State
The Governor's Executive Order 2020-44 provides that Sections 3 and 4 of Executive Order 2020-08 as amended by Executive Order 2020-39 are re-issued and extended through July 26, 2020.  Sections 3 and 5 as amended by 2020-39 state as follows:  

"Section 3. During the duration of and for no more than thirty days following the termination of the Gubernatorial Disaster Proclamations, the requirements in the Limited Liability Company Act, 805 ILCS 180/55-5; Uniform Limited Partnership Act (2001), 805 ILCS 215/1309; General Not For Profit Corporation Act of 1986, 805 ILCS 105/101.45; and Business Corporation Act of 1983, 805 ILCS 5/1.45, that the Secretary shall, within 10 days after delivery of any document required by those Acts to be filed with the Secretary of State, notify the filer if the Secretary disapproves of the document, are suspended. During this time the Secretary shall process these documents as expeditiously as possible.

Section 4. During the duration of and for no more than thirty days following the termination of the Gubernatorial Disaster Proclamations, the Secretary's obligations to provide expedited services as set forth in the Limited Liability Company Act, 805 ILCS 180/50-50; Uniform Limited Partnership Act (2001), 805 ILCS 215/1308; Uniform Partnership Act (1997), 805 ILCS 206/1209; General Not For Profit Corporation Act of 1986, 805 ILCS 105/115.20; and Business Corporation Act of 1983, 805 ILCS 5/15.95, are suspended."


Rulemaking
I will provide a summary of any new rulemaking over the next two weeks in my July 17 newsletter. 

Court cases
No new tax-related cases through June 30.

Tax Tribunal 
No new decisions were issued by the Tribunal this week. 

None of the new cases filed this week raise unique issues.

As of June 30, 65 new cases had been filed with the Tribunal during calendar year 2020.  This continues a downward trend in cases filed with the Tribunal, although this year's decrease is likely affected by the effects of the COVID-19 pandemic.

Publications
The latest edition of the Illinois Chamber of Commerce quarterly magazine,  Illinois Business Leader has been published.  The Illinois Business Leader includes the third of a series of articles I have written in opposition to the graduated income tax constitutional amendment.

My latest column has been published in the Illinois CPA Society's  Insight magazine.  I discuss the rulemaking process in Illinois.
